Can deleted text messages be recovered?

The short answer: Sometimes, yes.

Many people assume that deleting a text message means it's gone forever. In reality, digital evidence can be much more complicated. Depending on the device, backups, cloud storage, service providers, and the circumstances of an investigation, deleted messages may still be recoverable.

That's one reason it's important not to make assumptions about what investigators can—or can't—access.

On paper, the evidence against the client was strong.

A client came to Ron Herman after being accused of organized scheme to defraud, bribery, and corruption.

At first glance, the allegations looked convincing. There were accusations, documents, and a story that seemed to fit together into a compelling narrative.

If the case had ended there, it may have looked no different than everyone initially assumed.

But that's not how criminal defense works.

As Ron began asking questions and digging into the facts, the case started to change. The timeline didn't add up. The evidence didn't support the allegations. And it became clear that the person making the accusations had a financial motive.

The more the defense uncovered, the more obvious it became that this wasn't a bribery case at all—it was an attempt to use false allegations for financial gain.

In the end, the client was cleared.

One of the biggest lessons Ron has learned throughout his career is that looking guilty and being guilty are two very different things. The power of the government is strong.

That's why he never judges a case by the first version of the story. He follows the facts, challenges the evidence, and makes sure every client's side is heard.

One piece of legal advice you may not know you need!

A phone call can change the course of an investigation.

Not long ago, Ron Herman received a call from someone who had just been contacted by federal investigators.

She was anxious, confused, and ready to call them back.

Like many people, she believed the quickest way to put the situation behind her was to explain what happened.

Ron advised her not to make that call.

Not because she had anything to hide, but because investigations aren't designed to give people the opportunity to clear things up. They're designed to gather evidence.

Too often, people believe that being honest is enough. But even truthful statements can be misunderstood, taken out of context, or fill in gaps investigators didn't have before.

Instead of responding on impulse, Ron helped her take the time to understand what was really happening, evaluate her legal options, review the evidence, and develop the right strategy before anyone said another word.

That one decision changed the course of the case.

One of the most important pieces of advice Ron gives clients is simple: don't let panic make your first move.

A $906 million allegation makes for a compelling headline, but headlines are not evidence.

The Department of Justice has charged a Texas nurse practitioner in connection with an alleged Medicare fraud scheme involving wound grafts and has highlighted luxury assets it says were purchased with fraud proceeds. Those allegations are serious, but they remain just that - allegations until proven in court.

In white-collar cases, the government's press release often tells only one side of the story. Large dollar figures and asset seizures can create the impression that guilt has already been established, when in reality the legal process is just beginning.

Health care fraud prosecutions are rarely as straightforward as they appear. These cases often hinge on whether medical services were actually necessary, how complex billing regulations were interpreted, whether documentation supports the claims submitted, and—most importantly—whether the government can prove beyond a reasonable doubt that a defendant knowingly and intentionally participated in a criminal scheme.

REMEMBER mistakes are not crimes: civil billing disputes, regulatory violations, and poor business practices do NOT mean there was criminal fraud. Criminal intent is what separates a crime from a mistake, and proving that intent is often the most contested issue in these prosecutions.

Thirty-six people in Florida were charged as part of the Department of Justice's nationwide health care fraud takedown.

On the surface, it looks like another major enforcement action.

What caught my attention was something else...

According to prosecutors, these investigations weren't built on one piece of evidence. They involved billing records, financial transactions, digital evidence, witness testimony, and years of investigative work before charges were announced.

By the time a federal health care fraud case makes the news, investigators have often spent years putting it together.

That's why I tell people not to judge the seriousness of an investigation by what you see publicly. Long before an indictment is announced, the government may already have spent months, or years, building its case.

Officials are calling the 2026 National Health Care Fraud Takedown the biggest in U.S. history.
