A new Adjustment of Status application will become effective on September 18, 2026.

This updated application takes into consideration the end of the 2022 Biden-era Public Charge rule that limited an officer’s capacity to review all factors that may have made an applicant inadmissible when applying for adjustment of status if they were deemed to be a public charge.

Applicants applying must demonstrate that they would not be a public charge, relying on taxpayer funded government benefits.
