On this date in 1865, the legal doctrine of “strict liability” was established, whereby a person is held responsible for harm caused by a dangerous activity or substance on their property, irrespective of negligence occurring.

John Rylands, a mill owner, contracted workers to create a reservoir to power his mill, on his land. The workers unknowingly built the reservoir over abandoned coal mine shafts. Once Rylands had his reservoir filled, the water inside busted through and flooded the still-active mine tunnels of Thomas Fletcher, his neighbor. Fletcher sued and won despite Rylands not being the negligent party.

This landmark decision set a precedent whereby the focus shall be on the danger, not solely on carelessness. And, causation is paramount, as a direct link between the negligence (e.g., the construction of the reservoir over the shafts) and the problem (e.g., the mine tunnels being flooded) must be demonstrated.

In this context, “constructive knowledge” would be defined as the water being on the floor long enough for employees inside the store to notice it and clean it up.

Additionally, if the establishment has “actual knowledge” (e.g., a customer making them aware of the leak) and the slip and fall occurs before anything is done, the business can be held liable.
