After an Executrix filed a Petition For Declaratory Judgment to enforce the "No Contest" provision of the Decedent's Last Will to disinherit an heir for participating as a witness in a will contest to prevent the probate of Decedent's Last Will, KPHLAW successfully defended the heir and preserved her seven figure inheritance. In order for a "No Contest" provision to be enforced against an heir who was not a party to the challenge of the will it must be shown that the non-challenging heir participated in a "collaborative effort" to contest the will with the party that brought the action to contest the will.
