The 2021 hurricane season has just begun and Elsa and Henri have already made an appearance! Water damage can be devastating. Most homeowner’s insurance policies do not include flood insurance, which can be really expensive. Usually to have flood insurance you must have a separate policy or have it specifically put on to your standard coverage! Don’t set up your self up for surprises: dig out your homeowners policies now, see what coverage you have, and determine what you might need! #2021

All over the news is Bill Cosby, a man who was convicted of sexual assault and released from prison because after he spent three years out of a three-to 10-year sentence in jail, Pennsylvania’s highest court determined that the conviction was wrong. Considered one of the first celebrity convictions, many people are outraged.

Many news sources, not surprisingly, are not really explaining what the court’s ruling was. The court’s ruling had absolutely nothing to do with Cosby’s innocence or guilt, but rather was based on the constitutional concept of due process. Let us discuss and then you decide if you believe justice is being served by protecting our rights.

What is the First Amendment anyway? These days we all keep hearing about First Amendment Rights. We think we know what the term means – freedom to speak what we think – but is there more to it? There is! We exercise these rights by speaking freely, expressing ourselves through art, writing, protesting, dressing, attending religious services, or maybe even erotic dancing! While we do live in the land of the free, our First Amendment freedoms do have their limitations. WILL you be together for Thanksgiving?

Wow! What a crazy year! The holidays are coming, but boy are they different this year! Covid looms all around us and many of us are missing out on the big family gatherings; some of us limiting things to immediate family and others forgoing it all. The thing to remember is simply that it’s all about family, isn’t it?

So as lawyers when we think about family, often the first thing we think about are wills. Wills are often pretty touchy subjects, but it’s just one of those things that needs to be discussed and people should start to think about and perhaps get one.

Covid truly makes us realize how fragile life is; but in truth it didn’t take Covid to make it so. Holidays are a good time to talk to your loved ones, to think about your own desires and to take stock of what you have.

Many people don’t have wills and each state has laws which control where your stuff goes if you pass away without having one. This may be fine with you, but almost everyone has something they hold dear, that they would like to specifically say who gets it.

There’s also the issue of cost. Few assets? Your will may be simple and thus not costly at all!

Maybe a will is not what you are looking for and maybe you need a trust, a power of attorney or perhaps Covid has made you think of the medical decision making documents that you might need if you are not in a position to make medical decisions yourself.

So we recommend starting the conversation with parents and also with yourself! What documents have been prepared? What still remains? Have you considered who you trust enough to be your Executor, Trustee or Guardian (for your loved one or children)? Do documents need to be updated? Write down your assets, including accounts, online banking usernames and passwords and keep it in a safe place!

It’s much more complicated than even the above, but just start thinking, taking stock and talking to your loved ones during these times. Then reach out to us!

What has the Supreme Court done for you lately? As lawyers, we watch with amusement, as the media proclaims how the Supreme Court ruled this way or that, when they did nothing of the sort! So here we go - Supreme Court 101 and how the court really works and what their rulings mean.

How does a case get to the Supreme Court? Usually, there is a state law or action that somebody said violated the U.S Constitution or federal law. It usually starts at the state level and then to the federal level! All levels after the first one are simply a review of what the lower court did, not a fresh look at the case.

The Supreme Court usually just decides the narrowest of issues, usually technical ones rather than issues that go to the real substance such as “Should abortion be legal?” Yet the media often reports the Supreme Court’s rulings as being in favor of position when it has nothing to do with it! Lately, we find the media reporting that courts are dismissing cases when they are just denying particular motions like asking for the count to be stopped.

The media reported the famous Burwell v. Hobby Lobby Store case upheld freedoms for religious entities to deny health coverage of contraceptives to their employees, yet the Supreme Court case actually addressed one simple issue: whether a corporation was a “person”.

Take Roe v. Wade. Certain legal scholars think it should be overturned on two technicalities: the right to even bring the suit and whether a certain decision was beyond the Court’s power – not because abortion is right or wrong.

The media does a really poor job in advising the public about how legal cases really work, so don’t believe everything they say! Look at the actual court opinions! Get them online and read the synopsis at the very beginning. Google any legalese you don’t know. Before long, you too will understand what the Supreme Court is doing for YOU!

Hello there! We are the Rivkind Law Firm. As lawyers, we have started to notice how there appears to be few neutral sources out there that really let the public know how the law really affects us. We are going to try to do that here. We will decipher the law, give you well-informed information and present both sides of the argument. Then you can decide what to believe!

We will discuss issues from Covid and why you might consider drafting a Will at this time to the election, to the law’s effect on the economy, social issues, and health care, to some of those ballot questions that we all saw when voting across the country and what they actually mean.
