A federal jury in Asheville has acquitted a Cherokee man of first-degree murder and all related charges.

NOT GUILTY - FIRST DEGREE HOMICIDE - US DISTRICT COURT.

Today, a jury in the United States District Court for the Western District of North Carolina returned verdicts of NOT GUILTY on First Degree Murder and all related counts against our client, Derrick Cucumber.

After 22 long months in pretrial confinement, Derrick walked out of the courthouse today a free man and went home to his family.

There are moments in this profession that are difficult to put into words. The second photograph probably does a better job than I ever could.

This was a serious case, involving a tragic loss of life, and our sincere thoughts remain with Mario’s family and everyone affected by what happened that night. A verdict does not erase that loss.

But our system of justice entrusts twelve citizens with an extraordinary responsibility: listen to the evidence, judge the credibility of the witnesses, apply the law, and hold the Government to its burden of proof.

In this case, the central issue was one of our most fundamental legal protections: the right of self-defense.

Self-defense is not a loophole. It is not a technicality. It is a right. And that right means something only if we are willing to protect it when the stakes could not possibly be higher.

We are profoundly grateful to the men and women of Western North Carolina who served on this jury. Jury service takes people away from their jobs, their families, and their lives. They listened carefully, remained focused through a difficult trial, and performed one of the most important civic duties in our country. Without jurors willing to do that work, justice simply cannot prevail.

We also sincerely thank the United States Attorney’s Office for a thoroughly professional and well-tried case. Lawyers can fight hard on opposite sides of a courtroom and still respect the people, the process, and the profession.

To our wonderful court reporter, my sincere thank you for not killing me when cross-examination got going and I started talking at 900 words per minute. 😂 I apologize, and I am incredibly grateful for your patience and professionalism.

And thank you to the Court’s outstanding bailiffs and the United States Marshals Service, who took excellent care of everyone involved throughout the trial.

Most of all, thank you to Derrick and his family for placing their trust, his future, and ultimately his freedom in our hands.

There are few responsibilities greater than standing beside another human being when virtually everything in his life is on the line. Today the right thing happened!

Today, after 22 months, Derrick finally get’s to go home.

First Degree Murder: NOT GUILTY.

All related counts: NOT GUILTY.

Free. Home. With his family.

That is a day we won’t soon forget! 🫶

NOT GUILTY. TWO COUNTS.

Today, a Buncombe County jury found our client, John Foulk, NOT GUILTY on both counts of Death by Motor Vehicle.

John is a good, hardworking man who has carried the weight of these charges and everything that came with them. He trusted our office with his freedom, his reputation, and his future when the stakes simply could not have been much higher.

Today, twelve citizens listened carefully to the evidence, followed the law, and returned two verdicts:

NOT GUILTY.
NOT GUILTY.

We are incredibly grateful that John placed his trust in us, and it was truly an honor to stand beside him and fight for him.

At the same time, two people lost their lives in the collision at the center of this case. A not guilty verdict does not diminish that tragedy, and our sincere sympathies remain with their family and loved ones. There are no winners when lives have been lost.

I also want to express my deep appreciation to the members of our Buncombe County jury. Jury service takes people away from their jobs, their businesses, their children, and their families. Yet ordinary citizens answering that call and carefully deciding the most serious questions placed before them remains one of the great safeguards of our system of justice.

Thank you as well to our wonderful court reporter, Sherri Rogers, our Clerk of Court and courtroom staff, and the men and women of the Buncombe County Sheriff’s Office who work every day to keep our courthouse safe.

And most of all, John…

KNOW YOUR RIGHTS BEFORE YOU NEED THEM.

Most people will have some interaction with law enforcement while driving at some point in their lives. Usually, it is nothing more than a routine traffic stop. Sometimes, however, a routine stop can become something much more serious very quickly.

Over the years, I’ve watched good people make bad situations worse simply because they were nervous, frightened, confused, or didn’t understand their rights.

So I put together these two guides.

The first covers ordinary traffic stops and some simple things you can do to remain calm, protect yourself, and get through the encounter safely.

The second deals specifically with DWI investigations, where seemingly insignificant decisions made on the side of the road can have enormous consequences later.

The basic philosophy behind both is pretty simple: Be calm. Be courteous. Be compliant with lawful instructions. But know your rights and don’t unnecessarily give them away.

You do not have to argue with an officer to protect your rights. In fact, the roadside is almost never the place to argue your case. Your job is to get through the encounter safely and say as little as necessary. If there is a legal fight to be had, let your lawyer fight it later, in the courtroom, where it belongs.

Take a few minutes and read through both graphics. Save them. Share them with your kids, especially new drivers, and with anyone else who might benefit from knowing this information before the blue lights ever come on.

Know your rights. Protect yourself. And make good decisions when it matters.
