If you can be a convicted felon and still hold the highest position in our country, then you should be able to be a convicted felon and vote for the person who will hold the highest position in our country. AND we need to remove all criminal history related questions from employment applications, rental applications, finance/loan applications, and educational/licensing applications. No excuses! Do it now! The fact alone that it is currently lawful for a convicted felon to run the United States of America, should immediately nullify why someone’s criminal history is a considering factor on ANYTHING.

The most important aspect of Crimmigration is being proactive and identifying a more immigration friendly solution BEFORE criminal proceedings are completed (BEFORE conviction). If you are undocumented or a green card holder and you are in state criminal proceedings, it is important that you consult an attorney that understands any possible Immigration consequences that you might have.

Crimmigration also identifies what (if anything) can be done AFTER proceedings are concluded, in order to have the best possible chance in immigration court, or, to avoid immigration consequences entirely. The AFTER part of Crimmigration is also known as Post Conviction Relief (PCR).

Post Conviction Relief is usually some sort of a petition or motion made to the State Criminal Court in order to modify, reduce, expunge, vacate, or alter the plea, the sentence, or the record of conviction. Some states, like Virginia, have very limited forms of PCR, and most have very strict deadlines.

Summary of the SCOTUS DACA decision:

On June 18, 2020, the Supreme Court issued its decision on the DHS v. Regents of the University of CA et al, which dealt with the issue of whether the Department of Homeland Security rightly ended DACA. In a 5-4 decision, the Supreme Court ruled that the administration’s decision to terminate DACA was “arbitrary and capricious,” and therefore unlawful.

This decision means that DACA remains in place as of now. However, it is important to note that it also makes it clear that the administration can terminate DACA if it follows the proper procedures for ending the program.

The Department of Homeland Security has not issued cleared guidance on how it will proceed with the program given SCOTUS’ decision. Given the nature of the decision, it is likely that USCIS will resume accepting new applications for DACA. USCIS may also resume granting Advance Parole. For those who wish to renew their DACA, USCIS is currently accepting renewals as well.
