Divorce hurts, but the pain can be lessened if the parties commit to resolving the outcome by agreement. Joint petitions allow parties to speed up their resolution with less anxiety and more retention of outcome control. And mediation can help the parties close the gaps on areas of disagreement with the help of a neutral party who guides the discussion but still leaves the final decision up to the parties.

Courts are open and using telephone and video conferencing to conduct most hearings. For people who work out an amicable divorce through direct negotiation or mediation, the process is potentially more efficient and even cheaper than pre-Covid days. This is because virtual hearings are now scheduled for specific times of day. Previously, most cases were scheduled for 830 or 900 AM, and everyone had to hurry up (to get to court) and wait (for an undetermined time) for the judge to call their case in a packed courtroom. It could take an hour, it could take 5 hours. As of the current time though, most cases are scheduled for a specific time, called at that time, and parties save both their time and legal fees by cutting down on the waiting time by hours in many cases.

In a published decision today (Stacy v. Stacy), the Massachusetts Appeal's Court decided that Veteran's Disability Payments are not subject to division under Massachusett's Asset Division Statute (M.G.L. c. 208, s. 34). However, trial judges may still consider the disability benefits as a relevant factor when dividing the remaining assets in the marital estate.
