There are many steps to take when you are suing a city like DC. The first step is a statutory requirement known as section 12-309, which mandates that DC receive pre-suit notice from the potential plaintiff or its representative. My law firm represents Marquette Hopps, a 28 year old DC resident who was stopped at a gas station on Minnesota Ave, SE by MPD officers who claimed the moped that he was filling up was stolen. It was NOT stolen. During the encounter Mr. Hopes informed officers that he had his weapon on him and presented his license to carry. DESPITE SHOWING THIS EVIDENCE, he was arrested and jailed. One year ago today, my trial team won justice for Deon Kay. Today, DC Attorney General Brian Schwalb is fighting that verdict. Taxpayers are now paying $26,400 in interest on the award of $655,000 that a jury rendered last year. Brian Schwalb thinks this award is excessive and is asking an appeals court to overturn the verdict. Comment below and sign the petition in my bio. As a civil rights lawyer I saw it clearly: no probable cause to approach, and a Fourth Amendment violation when she was seized.

This is why D.C. needs a mayor with a backbone and a background in constitutional law. Not someone making promises about fighting the federal government. Someone who actually knows how.

I’ve done it in court for 15 years. I know how to build the legal resources and national network to protect residents when the federal government oversteps.

Update in the Kevin Shird Shooting Death Case: I am happy to announce that a trial date has been set in this case. On November 9 we select our jury. Only 1% of these cases make it to a jury so I am particularly happy about this and grateful to God to have the privilege of representing the strongest human beings in the planet. Losing a loved one to police violence is agonizing. The court process is hard. Jury trials test every fiber of your being and when you come out the Victor, you have defied an entire system.
