This 10-year period is determined based on the effective date of the VA’s original grant for service connection.

🌟 The VA 10-Year Rule Helps Veterans in 2 Ways:

Protection: If a Veteran maintains service connection for a condition for at least 10 years, their grant of service connection is “protected.” This means the service connection can no longer be terminated under the usual procedures, even if there is clear and unmistakable evidence.

Lifetime Benefits: The 10-year rule allows Veterans to receive VA compensation for their service-connected disability for the Vet’s life.

📝 Can VA Reduce a Rating After 10 Years?

The VA can reduce the veteran’s disability rating. The VA must first propose the reduction based on a review of the Veteran’s entire medical history. It must also allow the Veteran an opportunity to respond to the proposed change in rating.

Eligible Mental Health Conditions:

Anxiety disorders (e.g., panic disorder)
Trauma and stress-related disorders (e.g., post-traumatic stress disorder)
Psychotic disorders (e.g., schizophrenia)
Cognitive disorders
Mood disorders (e.g., major depressive disorder)
Residual effects of traumatic brain injuries (TBI)

Rating Scale: Mental health conditions are rated from 0% to 100% using VA’s General Rating Formula for Mental Disorders based on the severity.

Many Veterans go years and decades without VA disability benefits for their disabilities incurred during and after their military service because they either don't think they qualify for VA disability benefits OR they get overwhelmed with the process to apply for VA disability compensation benefits.

Veterans must have a "SERVICE-CONNECTED CONDITION"(SC) to be eligible for VA disability compensation. Examples of a "service-connected condition" can include: Diabetes, PTSD, Sleep Apnea, Tinnitus, Traumatic Brain Injury (TBI)

Even having "flat feet" prior to entering military service can be considered a "service-connected condition".

If you're a VETERAN with a SERVICE-CONNECTED CONDITION, you may also have a SECONDARY CONDITION, which means you may also QUALIFY FOR VA DISABILITY BENEFITS.
