Johnny Olszewski is introducing the Reform of Bench Eligibility (ROBE) Act, a proposed constitutional amendment that would impose 18-year term limits on U.S. Supreme Court justices.
Olszewski said the proposal comes in response to growing concerns about the Supreme Court becoming increasingly partisan, particularly following a recent ruling that critics say weakened the Voting Rights Act. He also pointed to ethical controversies involving sitting justices, including attendance at White House state dinners, acceptance of luxury gifts from political donors and friends with business before the court, and allegations surrounding political displays after the January 6 riots.
“Faith in the Court depends on its legitimacy as a fair and independent institution,” Congressman Olszewski said. “Recent rulings that have thrown out decades of legal precedent, combined with ethically dubious behavior by sitting judges, are testing that faith. Justices should not be hobnobbing at White House dinners and flying on the private jets of friends who have business before the Court.
By establishing term limits, we can reduce the political gamesmanship surrounding appointments, restore balance to the process, and strengthen the integrity of the Court.”
Currently, Supreme Court justices serve lifetime appointments, with some remaining on the bench for decades. Olszewski argues that the system has encouraged increasingly politicized confirmation battles and strategic retirements tied to presidential administrations.
The ROBE Act would create regular turnover on the Court through 18-year terms and include a transition plan that would also apply to current justices. Supporters say the change could lower the political stakes of each nomination and help rebuild public trust in the judiciary.
