It has been a while since I posted on social media, but I think it's time to start again. Her is a recent artcle that I wrote about Donald Trump and how he negotiates. Let me know what you think.

Well, we are one week into the Sean “Diddy” Combs trial, and it is time to check and see what has happened thus far. The short answer is a good bit, but not much.

Although many people recognize us as white collar criminal defense lawyers, we also represent victims of crimes. The following article was recently published on the Boyle & Jasari blog concerning the defrauding of the elderly. I hope that you find it useful.

The sad reality of modern American society is that on an almost daily basis, we hear stories of retirees who have lost a portion of their entire savings or their entire life savings through the fraud of a third party, often a person that will never be identified.

Here is a recent article on FINRA arbitrations for people who lost money through the fraud or financial mismanagement of their accounts. Hopefully, it will provide some useful information.

We just finished a FINRA (Financial Industry Regulatory Authority) evidentiary hearing—it is the third arbitration we have successfully finished in the past year.

My novel, The Beast of Winter Haven was published about six weeks ago. At the time, I was in trial, and I haven’t had much time to work on marketing it.

The novel is about a werewolf, and a trial wherein the defense attorney must prove the werewolf’s existence to save an innocent client. Several people have commented favorably the story. It’s available on Amazon.com and Barnes and Noble if you’re interested in reading it. If you do decide to read the novel, I would appreciate your feedback back.

I have often been told that there is an ancient Chinese saying (well, maybe its more of a curse) that says "May you live in interesting times". More recent research I have conducted suggests that the saying is neither ancient nor Chinese, but it does fit with where are at as a people and as a nation. Last week, the Supreme Court heard arguments on Presidential Immunity, if, indeed, there is such a thing. Not long before that, however, President Hernandez, the former President of Honduras, was convicted in New York of crimes committed suring his presidency--not immunity for him I suppose. Here is a blog post concerning his conviction.

In this blog post, I will illuminate the complexities of resolving financial disputes througharbitration by focusing on a case which my partner, Dennis Boyle, and I have recently resolvedagainst AT&T.

Real Estate Investment Trusts (REITs) are often marketed as a way to diversify an invesment portfolio. Unfortunately, non-publicly traded are often a poor investment--fraud, mismanagement, conflicts-of-interests, etc.--are common problems. The article below discusses the suitability of these investments.

Investing in real estate has a certain appeal to many people. The investment is, or at least appears to be, tangible—he investor can visit the shopping mall or condominium complex.

The Right to Financial Privacy

When I was younger, I thought that there was a right to financial privacy in the United States. After more than 30 years of practice, however, I can tell you that despite statutes like the Bank Secrecy Act, there really is no such thing as financial privacy. The following article from CATO provides an excellent explanation of financial privacy in the United States--or that lack thereof. I highly recommend reading it.

Financial privacy in the United States has been in disrepair for more than 50 years.

Affinity Fraud--Among the FBI's Most Wanted.

When one thinks of the FBI's most wanted list, it conjured up images of international terrorists and arms traffickers, mafia figures, and the leaders of international drug cartels. Nestled within this group of the nation's most dangerous criminals is an individual described as a devoted father, a loving husband, a former youth pastor--indeed, the type of person any of us would like to call a friend.

I know the same can be said for many serial killers, but Christopher Burns is not alleged to be a serial killer. Instead, he is accused of wire fraud. At some point in the past, Burns moved from the pulpit to the financial services industry, where, according to the government, he is alleged to have engaged in a $10 million affinity fraud scheme. Affinity fraud occurs when a fraudster uses a connection he has with a group--frequently a religious group--to perpetrate a scheme to defraud, usually a pyramid scheme. They are insidious because they prey upon the mutual trusts that exists within many religious communities.

One other point: although there is a certain fame associated with making it onto the "FBI Most Wanted List, it is not the place to build a successful defense or mitigate one's criminal conduct. There is a lot that can be done to defend someone accused of wire fraud or to mitigate the sentence that might be imposed. Running, however, is never the best strategy.

Defending Clients in Multi-Defendant Cases

Defending clients in multi-defendant cases is one of the most challenging aspects of criminal defense. Severance is rarely granted, and being shackled to a incompetent or crazy co-defendant or co-counsel can be a nightmare. Attached is an article that addresses this issue:

One of the realities of modern criminal defense in federal criminal cases is that in most cases, there will be multiple defendants in a single trial.
