King University has signed an agreement with Appalachian School of Law. This “3+3” agreement allows students to apply to Appalachian School of Law school after three years at King University, instead of the traditional four year degree.

MY CLIENT was wrongly charged with: a traffic infraction, a revocation of license, and a DUI… ALL charges dropped completely!

Now…the rest of the story. My client entered America through a visa and under a non-citizen status. After years of work and waiting (he himself did the work) he obtained full citizenship. My client was wronged by the exact system he fought so hard to achieve citizenship status in.

Thereafter, he was falsely charged with: a traffic ticket, a revocation of license, and a DUI.

Months later, after the combination of hard work from our office and my client all charges against him were dropped completely!

Since I have recently been able to take on cases in United States District Court, which requires a different license completely, I wanted to highlight the differences in State Court and District Court.

State courts and district courts are two different types of courts in the United States legal system. While both types of courts are responsible for hearing and deciding cases, there are some significant differences between the two.

State courts are courts that are established by state governments to hear cases involving state law. These courts have jurisdiction over a wide range of cases, including criminal, civil, and family law cases. State courts are typically divided into two main categories: trial courts and appellate courts.

Trial courts are the first level of state courts, where cases are first heard and decided. These courts are responsible for determining the facts of a case, weighing evidence, and making decisions based on state law. Appellate courts are the second level of state courts, where appeals from trial courts are heard. These courts are responsible for reviewing the decisions made by trial courts and determining whether they were made correctly.

District courts, on the other hand, are federal courts that have jurisdiction over cases involving federal law. These courts are divided into 94 districts across the United States, and they are the first level of the federal court system. District courts are responsible for hearing a wide range of cases, including criminal, civil, and bankruptcy cases.

One of the key differences between state courts and district courts is the types of cases they hear. State courts have jurisdiction over cases involving state law, while district courts have jurisdiction over cases involving federal law. Additionally, state courts are responsible for hearing a wider range of cases than district courts, including family law cases, traffic violations, and small claims court cases.

Another difference between state courts and district courts is the appointment process for judges. State court judges are typically elected by the people, while district court judges are appointed by the President and confirmed by the Senate.

In terms of procedure, state courts follow their own rules of procedure, which can vary widely from state to state. District courts, on the other hand, follow the Federal Rules of Civil Procedure and the Federal Rules of Criminal Procedure.

Overall, while both state courts and district courts are responsible for hearing and deciding cases, they are two distinct types of courts with different jurisdiction, appointment processes, and rules of procedure.

A BIG DAY AT THE OFFICE!!!

Very honored and blessed to say that I have been admitted to practice in the United States District Court for Washington, DC!

In short, this means I am now able to take on federal cases. Federal cases require a separate license rather than a bar-given admission to practice.

WEEKLY BLOG POST #2:

About 60% of my practice consists of DUI defense. The other 40% I try to vary as much as I can to learn and keep growing. This particular case concerns a former Client of mine who received two photo tickets from Washington, D.C. traffic trap cameras.

For those that don’t know, Washington, D.C. speed trap cameras have faced class action law suits due to how Washington, D.C. classifies them to beat certain evidentiary rules.

They classify the tickets as civil infractions…not traffic violations. So what exactly does that mean?

Broadly, it means if the government says you did it...goodluck beating it because there are ZERO witnesses that can be called.

Yes…that’s right.

So, that leads me to my current story with my former Client. They received not one but TWO tickets from the same speed trap camera in the exact same day.

At the hearings, we successfully were able to get the second speed trap ticket COMPLETELY DISMISSED due to our argumentation with Washington, D.Cs’ duty to mitigate under these circumstances. The Client was extremely easy to work with, and an absolute pleasure to get to know throughout this long process.

As I mentioned above, beating a speed trap ticket is almost impossible…but I write this to simply show that it can be done!

**Long Post Ahead**

Everyone, today is a very special day. It is the “1 year anniversary” of when I decided to open my own law office!

First, I just want to say thank you to God and I could not have done this without him.

Second, thank you to everyone that has entrusted me, referred me, told someone you know that needed help, or merely just wanted to call and ask me a question. I am absolutely humbled by responses I have received.

During my first year of being open, my office saw an estimated 115% growth…yes that’s right…115%. So, that leads to the next step, of “where do we go from here?”

The first thing, is that I am now almost to the point of accepting job applications for various positions, I am not exactly sure what this process will entail, but the future is bright!

The second thing, is that I now am going to start sharing blog posts of thoughts, tips, and information that I have found in my practice of the law. As always, this is just general information and you should consult an experienced lawyer about your case…

So here we go…and thank you to everyone who’s helped along the way!

BLOG POST #1:
I RECEIVED A DUI/DWI CHARGE…NOW WHAT?

This is the first question I receive when I have a client call me. "What do I do now?"

Immediately, the first thing I discuss is your license. The reason being? You have 10 days or 15 (depending on if you are a D.C. resident) to schedule a hearing. If not? Immediately, your license is revoked.

The second thing I always ask is "did you blow into the breathalyzer?" There is no good answer to this unfortunately, every case is different as to if you should or should not do it. There are many other factors that impact your case rather than just this test. This is the part where lawyers really make their impact because we know the NHTSA requirements, police officer procedures, and how to apply this in the courtroom.

From then on, every case is different and it takes an experienced DUI/DWI lawyer to know what happens next; call me NOW so we can discuss 276-492-0671

To be the only member in this years attendance from Washington, D.C. and also one of the youngest new members is truly outstanding. Just a quick update on what all has been going on in my office: Over time offices, businesses, and lawyers develop and learn. I am proud to say that my office has developed a keen interest in helping those accused of DUIs/DWIs.

I have had the privilege of working with those wrongly accused, those who needed their cases dropped, and those who were the victim of an abuse of the legal system to which my office helped them with the outcome of their case.
