Being charged with a DUI/DWI is serious and could have significant collateral consequences if convicted. Nearly all DUI/DWI charges emanate, at least in part, from the results of field sobriety tests. In many instances, police rely on the results of field sobriety tests to make an arrest, and prosecutors rely on the results to fashion their case against you.

You have a right to refuse a field sobriety test and, for a variety of reasons, many people do. That said, you should only make the decision to refuse the test after fully considering the implications.

The Fifth Amendment protects against being compelled to make statements to the government that are incriminating. Nevertheless, people talk. Most times, when they shouldn't. The pressure to talk is often most pronounced when in the custody of the police and subject to interrogation. This is a dangerous situation to be in because this is when statements are made that might be incriminating.

The Supreme Court considered this and held that when a person is subjected to custodial police interrogations, they must be informed of their right, prior to questioning, to have counsel present.

The Fourth Amendment protects against unreasonable searches and seizures by the government. However, the keyword here is unreasonable. Refusing an officer's request to search you or your property is your right, but if officers have a valid warrant, the search can occur.

Even in the absence of a valid warrant or your consent, officers may still have the right, under some circumstances, to conduct the search.

Arguably, one of the most overlooked and least exercised rights in the U.S. Constitution is your right to remain silent when interacting with law enforcement. The right is rooted in the Fifth Amendment to the Constitution, and it protects individuals from being forced to make statements that might incriminate them.
