Buying a home is a major investment. At the closing table, you may be offered an owner's title insurance policy. What does it do, and is it worth considering?

There are generally two residential title insurance policies:

- Lender's title insurance protects the mortgage lender. It is typically required by the lender, but it does not protect your financial interest in the property.

- Owner's title insurance protects your ownership rights and financial investment in the home. It is optional, but often recommended, and you pay the premium once at closing.

An owner's policy may help protect you if a covered issue is discovered after you receive the keys, such as an undisclosed lien, unpaid property taxes, a forged signature on an old deed, or an error in the public records.

A one-time premium can provide long-term peace of mind. Before signing, your closing attorney should review the title commitment and explain what the policy covers, along with any exclusions or exceptions.

Tomassi Law provides experienced Rhode Island title and closing counsel with clear communication throughout the process. Our closings are available in English and Spanish.

A Rhode Island Supreme Court decision offers an important estate planning lesson: an estate property sale to a co-executor was voided because probate court approval had not been obtained.

Executors and co-executors have fiduciary duties. They must act in the estate’s best interests, follow probate requirements, avoid conflicts of interest, and handle estate property carefully. Choosing an executor should involve more than selecting a family member. Trustworthiness, judgment, organization, and willingness to follow legal procedures all matter.

When creating or updating your will, ask whether your chosen executor is prepared for the responsibility. Personalized legal guidance can help you make informed decisions and plan for your family’s future.

A business built over many years deserves a plan for what happens when its owner retires, dies, becomes disabled, or must leave unexpectedly.

For Rhode Island business owners, succession planning is an important part of a broader estate plan. A practical plan may address:

• Who could succeed the owner, including family members, key employees, partners, or an outside buyer.

• Who has authority to make decisions during a transition and how that authority is documented.

• How ownership will transfer, including buy-sell arrangements, valuation methods, and funding sources.

• Key contracts, licenses, financing obligations, and other relationships that may affect continuity.

• How to support employees, customers, vendors, and operations during the transition.

Business interests should also be coordinated with wills, trusts, powers of attorney, beneficiary designations, and tax advice where appropriate. A well-designed plan can reduce uncertainty, protect family relationships, and help preserve the value and continuity of a business. The right structure depends on the business, ownership, and family circumstances.

Rhode Island sellers should account for the state’s updated real estate transfer tax when planning their net proceeds.

Effective October 1, 2025, the transfer tax increased from $2.30 to $3.75 per $500 of the sale price. The tax applies to sellers of all property types, with an additional tier for residential sales over $800,000.

Before closing, sellers should:

- Understand how the transfer tax appears on the closing statement.

- Factor the tax into their expected net proceeds.

- Review the documents and disclosures prepared by the title and closing team.

- Ask questions about every line item before signing.

At Tomassi Law, LLC, we have 20 years of real estate experience and more than 16 years of legal experience helping Rhode Island sellers navigate title and closing matters. We coordinate closings, review closing statements and transaction documents, and explain each item clearly so you can move forward with confidence.

A $1 million trust distribution was denied after the beneficiary could not prove he was the decedent’s “significant other” at the time of death.

The practical lesson for Rhode Island families is clear: trust language matters. Terms that seem obvious in everyday conversation may require specific proof in court.

Review your estate plan to confirm that it:

- Defines important relationship terms clearly.

- Identifies beneficiaries precisely.

- Keeps beneficiary designations current after marriage, separation, divorce, or other major life changes.

- Reflects your intentions across trusts, wills, retirement accounts, and insurance policies.

Beware of title companies and law offices offering kickbacks for your referrals.

Beware: Offering or accepting kickbacks for real estate referrals is illegal and unethical: for the title company or law office offering them and for the real estate professional accepting them.

Your referrals to your clients should be based on the services provided to them: not the extra cash you may be getting.

Tomassi Law, LLC does not participate in or endorse this practice. We let our work and services speak for themselves.

If you want your clients to receive the best closing experience and care about the legal representation and protection of your clients’ interests, the choice is clear: Tomassi Law, LLC. The “Gold” standard for real estate title and closing services.
