Before you close on a house in a subdivision, or a condo, or a lot, READ THE COVENANTS AND RESTRICTIONS. It is amazing how many people call asking "can they make me do this or that" AFTER they are already living in a neighborhood. They usually have no idea there are even restrictive covenants that attach to their property. These should be made available for review BEFORE closing and should be inquired of before signing a sales contract.

If you are married and die without a will in Alabama, here is how your estate is divided:

The intestate share of the surviving spouse is as follows:

(1) If there is no surviving issue or parent of the decedent, the entire intestate estate;

(2) If there is no surviving issue but the decedent is survived by a parent or parents, the first $100,000.00 in value, plus one-half of the balance of the intestate estate;

(3) If there are surviving issue all of whom are issue of the surviving spouse also, the first $50,000.00 in value, plus one-half of the balance of the intestate estate;

(4) If there are surviving issue one or more of whom are not issue of the surviving spouse, one-half of the intestate estate;

(5) If the estate is located in two or more states, the share shall not exceed in the aggregate the allowable amounts under this chapter.

You need a will to make it happen differently. Also, a will can remove the burden from your child or spouse of having to post a bond, file an inventory, file a settlement or seek court approval to sell any estate property.

Power of Attorney is extremely helpful when you have an elderly relative that isn't able to handle their affairs because they can't physically get around to do it. A General Durable Power of Attorney, executed while they are mentally competent, is effective even in the event they become incompetent later.
