Beware of the forbearance scam! Please note that if your mortgage company offers a mortgage forbearance due to COVID-19, you will need to restart payments at the end of the forbearance period and you are still responsible to make those payments after the forbearance period ends. In other words, if you have a 3 month forbearance, you will have 4 payments immediately due once the forbearance ends. If you do not come current, your lender has the right to foreclose on your home. Pay your mortgage if you are able, even if you are offered a forbearance. The mortgage company's help is no help at all. Also, pay attention to what is in writing, not what is told to you. The writing is what counts and the two do not always match.

For those of us who are sending our adult children off to college, it is important to think of the current COVID-19 pandemic and to prepare for the potential spread of the disease. Our children are traveling to strange environments and they will be independent, often for the first time. We cannot guarantee that they will practice social distancing, wear masks when they need to, or even practice proper hygiene.

We may still be their parents, but our children are now adults. As adults, they no longer fall directly under our care, when it comes to medical issues. We no longer have full control of their healthcare and we cannot intervene with medical decisions without their consent. For this reason, it is important to take precautions and to have a system in place to help our adult children when they need us most. One simple step you can take is to have your child execute an Advanced Medical Directive (a/k/a medical power of attorney), that will allow you, as parents, to still make medical decisions for your children when they are unable to do so for themselves.

The majority of the lenders and servicers are in the process of setting up or have already set up programs to help borrowers who have been affected by the current COVID-19 pandemic depending on the investor or loan type. The CARES Act, section 3513, signed into law on March 27, 2020, requires the Secretary of Education to “suspend all payments due” for federally-held student loans until September 30. 2020.

The same section provides that interest shall not accrue on any loan for which payments are suspended. The law supersedes the prior Education Department administrative action suspending interest for 60 days. Note, the third subsection provides that “The Secretary shall deem each month for which a loan payment was suspended under this section as if the borrower of the loan had made a payment for the purpose of any loan forgiveness program or loan rehabilitation program.”

The law also mandates zero interest for the next 6 months.

Borrowers, in Income Driven Repayment ("IDR") payment plans, are entitled to have their servicer recalculate their monthly payment based on current income if they lose a job or have reduced income. Borrowers may want to have their IDR recalculated based on their current income.
