***** I have always questioned why we have to identify and report each spouses’ race as we file for divorce. Caucasian, Hispanic, Black, Native American, Asian - How does this change the fact that a party is seeking a divorce? How does it change the result?
It shouldn’t. And LOL, I can’t see the other spouse when I meet my client so I have to ask the question - what race is your spouse? And what race are you?

It’s about the last thing on the mind of someone going through a divorce.

Judge: Marriage race question unconstitutional

ALEXANDRIA (AP) A federal judge has refused to dismiss a legal challenge by a group objecting to a requirement that race be listed on Virginia marriage license applications.
A lawsuit filed last month against the state registrar and two Virginia court clerks challenges the state requirement to list race.
In a decision issued Oct. 11, U.S. District Court Judge Rossie D. Alston Jr. rejected a motion to dismiss the challenge. He wrote that the requirement is unconstitutional because it denies the plaintiffs their constitutional right to due process.
Alston’s ruling also prevents the state from enforcing the requirement, saying it burdens the individuals’ right to marry.
State Attorney General Mark Herring wrote in mid-September that circuit court clerks, by law, must ask people seeking a marriage license their race, but he said couples can decline to answer the question.
“We won” trumpeted attorney Victor M. Glasberg, who brought the lawsuit on behalf of couples seeking marriage licenses.
“We’re very pleased, of course,” Glasberg said in an email. “The only unfortunate part is that it took a United States district judge to strike a Jim Crow provision that the state of Virginia insisted on defending in court,” he said.

🐾 ANIMAL CRUELTY IS NOW A FELONY IN VIRGINIA 🐾

Virginia Governor Ralph Northam has signed into effect a bill dubbed “Tommie’s Law.” It’s named for the pit bull who was found tied to a pole, doused in accelerant, and set on fire at Richmond’s Abner Clay Park and died five days later. Under current law, animal abusers can only be charged with a misdemeanor unless the animal dies. The new bill makes animal cruelty of a dog or cat a Class 6 felony, which is punishable by up to five years in prison and a fine of up to $2,500. The law goes into effect July 1, 2019.
