CASE DISMISSED: A Victory For Constitutional Rights
I'm pleased to share a significant win for my client and for constitutional protections.
The facts: My client was detained by the Massachusetts State Police after a civilian requested a wellness check. She was cooperative, explained where she was going, and posed no threat.
State Troopers then searched her backpack without a warrant, without her consent, and without legal justification. They found a small amount of ketamine she was carrying for therapeutic purposes and charged her with drug possession.
I filed a motion to suppress the evidence, arguing this was a Fourth Amendment violation.
The Dudley District Court agreed.
Today, the evidence was suppressed and the Commonwealth dismissed the charges.
A victory for my client and a great day for the rule of law.
