RV sales are up. Despite the coronavirus pandemic - people are traveling.

Most new RV owners are getting behind the wheel, having no experience in recreational vehicle operation. Newbies can drive any vehicle under 26,000 pounds. Select states require a non-commercial class B license to operate a class A or class C motorhome, either based on the motorhome's GVWR or length.

Suppose you are involved in an out-of-state RV or car accident that results in severe injuries to yourself or a loved one; you need to talk with a personal injury attorney. In almost all cases, you will follow the laws of the state where the car accident happened. Out-of-state accident cases are rarely cut and dry. Call an attorney, you know. It's best to use a lawyer who is licensed in your home state and the state where the accident occurred. If you were involved in an auto accident last week and thankfully walked away, that's a good thing. You're fortunate, however what if you injured yourself without realizing it? What if months went by, and one morning before your alarm went off, your neck began throbbing and woke you up - for no reason? It doesn't go away; it starts getting worst. You go to your family doctor, and the doctor asks, "have you recently fell or had an accident?" At first, you say "no," and then realize you were involved in an auto accident months ago. Is the car accident the cause of your neck pain? It certainly can be.

Sections 335.1 and 340 of California's Code of Civil Procedure, a personal injury victim must generally file a claim within two [2] years of sustaining the harm, which means that the plaintiff [usually] has two [2] years in which to file a personal injury lawsuit from the date of his or her injury.

It's important NOT to feel guilty for filing a personal injury lawsuit. No one wants to file a lawsuit. An honest attorney will tell you right from wrong. PERIOD. If the facts line up. The documents and timeframes will reveal the truth.

Another five (5) star review for Brand Peters Attorneys - our entire team works hard each day for clients like CC from Brentwood, California. We only wish we could have been doctors and took away CC's pain completely.

As attorneys, we work long hours and often for years to resolve some cases. The work is far from easy, and if it were easy, everyone would be doing it. Most of us in law, understand the law profession isn't one that gets public recognition unless it is a high-profile criminal case. Most attorneys we work and network with do not practice law to be recognized by society. We do it for people like CC who got hit by an underinsured motorist and could not work while being treated for sustained injuries. CC's insurance did not cover the accident expenses, including a hospital stay, medical treatment, or wages lost during recovery.

Reviews are hard to get, especially ones like CC's. Most clients do not understand the importance of reviewing a business. DO NOT FILL OUT A DWC 1 WITHOUT CONSULTING A WORKERS COMP ATTORNEY FIRST.

When a California employee suffers a job-related injury or illness, he or she could be eligible for Workers' Compensation benefits. Completing a Claim form (DWC-1) is the first step in the process. By an employer providing an employee with this form, they're not admitting liability (nor is the employee), but merely both are complying with the law.

In most cases, filing a workers' comp claim in California is actually a three-step process:

✓ Reporting the injury
✓ Filing the actual claim with your employer, and
✓ Filing an "application for adjudication of claim" with the Workers' Compensation Appeals Board (WCAB).

There are time limits for each of these steps. In some circumstances, you might get away with being late on the first two steps. But if you've missed the deadline for the last step—and your employer's insurance company balks at providing or continuing benefits—you could be out of luck.

An experienced workers' comp lawyer can explain how the law applies to your situation and help protect your rights. An attorney can also represent you in an appeal if your employer denies your claim for any reason.

At a typical worker's compensation hearing the following people are present:

Lawyers
The judge
Court reporter
Witnesses
Your employer or a representative
Someone from the insurance company

Keep in mind most workers' comp hearings are resolved on the same day, but more complicated cases can take longer.

This is usually the step most injured workers are concerned about since they fear their answers may lead to the judge dismissing their case altogether. It’s important to remain calm when you testify, and always stick to what you know to be true. When you don’t know, or don’t remember something, it’s best to be honest, rather than try to guess. This is usually the mistake most people make when they testify.

If you have hired an attorney they will prepare you and make certain all evidence and documents you need relevant to your claim are ready to be presented.

In most workers' compensation cases. The judge will want to hear your story and want you to testify. Keep in mind the defense attorney has the right to cross-examine you. You will be under oath the entire time.

Looking for an Attorney? The best resources are friends and family, the internet, and your doctor! Believe it or not, your doctor [and his/her staff] knows the best workers' comp and personal injury lawyers in town.

What most people do not realize is that attorneys like doctors have specialized areas of practice.

If you are filing for divorce, you need a divorce lawyer. Filing for bankruptcy? There are lawyers who handle nothing but bankruptcy cases. And if you're looking to fight a worker's compensation claim, well, you need a worker's compensation attorney.

Communication is key. One of the first questions you should ask the attorney is if it's okay to call or email them throughout the case to discuss concerns. If the attorney hesitates or makes an excuse, this is an indication that you will have trouble with communication. Second question: Will I be given updates in writing or by phone? And the third most important question: Will the attorney be the main point of contact, or will communications be delegated to a paralegal?
