"I didn't know there was a deadline." We've heard that a few times.

In New Jersey, most personal injury lawsuits have to be filed within two years of the injury. Miss that window and you may lose the right to recover anything, no matter how strong your case is.

Some deadlines are much shorter. If your injury involves a public entity, like a pothole on a town road or a crash with a government vehicle, you may need to file a formal notice of claim within 90 days.

Every situation is different, and exceptions exist. If you've been hurt, the safest move is to ask an attorney about your timeline early.

Injured in an Uber or a Lyft? The answer to "whose insurance covers this" depends on something you'd have no reason to think about: what the driver's app was doing at the moment of the crash.

App off, driving for themselves: it's their personal policy.

App on, waiting for a request: the rideshare company's contingent coverage may apply, usually at lower limits.

On the way to you, or with you in the car: the company's full commercial policy is typically in play.

Three very different answers to the same crash. And as a passenger, you're usually in the strongest of the three, which is exactly why it's worth knowing.

The details still matter. But the starting point isn't "who was at fault". It's "what was happening on the app."

If you ride an e-bike in New Jersey, the rules changed under you this summer.

Enforcement started July 19. Since then, an officer can ask you for three things: a license, a registration certificate, and, depending on what you ride, an insurance card.

Every e-bike now needs a license and MVC registration. Riders 17 and up can use a regular driver's license. Riders 15 and 16 need a motorized bicycle license, which means a knowledge test and a road test. Under 15 can't ride one at all.

Insurance depends on the bike. Throttle-capable models need liability coverage. Pedal-assist models capped at 20 mph don't.

And the three-class system most riders learned, Class 1, 2, 3, no longer exists in New Jersey. If you bought your bike before January, the framework it was sold under is gone.

Meet Leigh and Ken.

Leigh spent years on the insurance side of car accident claims: the litigation, the arbitration, the rooms where it gets decided what someone's injury is worth.

She works the other side of it now, and that history is the whole point. When an insurer makes a move in one of her cases, she has almost certainly seen it before, from the other end. It's harder to be caught out by a playbook you used to work from.

Ken arrived from the opposite direction: certified by the New Jersey Supreme Court as a civil trial attorney, which in practice means being ready to take a case all the way when that's what it takes.

A cyclist hit by a car in New Jersey gets PIP. Put a motor on the same device, on the same street, in the same collision, and the rider gets nothing.

It comes down to one phrase. New Jersey's no-fault law extends PIP to "pedestrians," and the statute defines a pedestrian as someone not occupying a vehicle propelled by anything other than muscular power. Your legs qualify. A motor doesn't.

In May 2024, the New Jersey Supreme Court applied that literally. An e-scooter rider struck by a car wasn't a pedestrian under the law, so he wasn't entitled to PIP at all — no immediate medical coverage, despite carrying an auto policy.

That's up to $250,000 that isn't there. Instead of coverage paying while you recover, you're covering the bills yourself and pursuing the at-fault driver through the courts, which takes time.

New Jersey's new e-bike law closes the gap going forward. If you're riding today, you're in a different position than riders were two years ago.
