You’re not alone after a pedestrian or bicycle crash. The impact can be overwhelming: and determining who’s responsible isn’t always straightforward.

Fault may involve a distracted or speeding driver, a failure to yield, unsafe road conditions, or the actions of a pedestrian or cyclist. Virginia generally follows contributory negligence: not comparative negligence. That means a finding that an injured person was even slightly at fault may affect or prevent recovery, depending on the facts and applicable law.

After an accident, protect your claim by:

Taking photos of the scene, vehicle, bicycle, helmet, and visible injuries
Getting contact information from witnesses
Requesting the police or incident report
Seeking medical care and following treatment instructions
Keeping records of symptoms, bills, missed work, and related expenses
Preserving your bicycle, helmet, clothing, and other evidence

Trial-focused legal strategy matters in Virginia because court is where pressure becomes proof.

If you’re dealing with a civil dispute or criminal charge, the strongest case usually starts long before anyone steps into a courtroom. It starts with the facts, the timeline, the records, and a plan built for how a judge or jury will actually hear your side.

That’s why we focus on preparation, not guesswork. The goal is to turn what happened into a clear, credible story that supports your position.

You’re not alone. When a co-parent repeatedly interferes with court-ordered custody, visitation, or parenting time, the situation can feel overwhelming: and Virginia law may provide enforcement options.

A Virginia court may consider contempt when someone knowingly and willfully violates a clear custody or visitation order. However, contempt isn’t automatic. The specific language of the order, the circumstances, and the available evidence all matter.

Practical steps:
• Keep a copy of your current signed custody order.
• Maintain a dated log of missed visits, denied exchanges, and canceled parenting time.
• Save texts, emails, call records, and other relevant communications.
• Continue following your own obligations under the order.
• Don’t retaliate by withholding parenting time or changing exchanges on your own.
• Speak with a family law attorney about whether a motion to show cause, contempt proceeding, enforcement request, or custody modification may be appropriate.

You’re not alone after a crash involving a driver suspected of ma*****na or other drug impairment. As Virginia prepares for a regulated retail cannabis market, impaired driving remains illegal: and injury victims still have important rights.

In Virginia, impairment is evaluated case by case through officer observations, field sobriety testing, blood testing, and other evidence. If another driver’s impairment caused your injuries, you may be entitled to seek compensation for medical bills, lost wages, pain and suffering, and other losses. Depending on the facts, an employer, vehicle owner, or another party may also share responsibility.

After the crash:

Call 911 and report any suspected impairment.

Seek medical care promptly: even if symptoms appear later.

Document the scene, vehicle damage, visible injuries, witnesses, and your treatment.

Do not delete or alter relevant phone information, and ask an attorney about preserving vehicle data and other records.

Before giving a recorded statement or accepting a quick settlement, speak with a personal injury attorney.

As students return to school across Hampton Roads, drivers and parents should review Virginia’s school bus safety laws.

When a school bus is stopped with flashing warning lights and its stop sign or crossing arm extended, drivers approaching from either direction must stop and remain stopped until everyone is clear and the bus begins moving again.

The main exception: You generally do not have to stop for a bus on the opposite roadway of a divided highway when a physical barrier or unpaved area separates the roadways. Still, use caution: children may be nearby.

Passing a stopped school bus is more than a safety mistake:

• Under Virginia Code § 46.2-859, the offense may be charged as reckless driving, creating serious criminal consequences: even for a first-time driver.

• Under § 46.2-844, a violation may result in a $250 civil penalty.

• Some Virginia localities use school bus cameras. These systems can capture the vehicle’s license plate, the bus’s activated warning device, and the date, time, and location of the alleged violation. An additional administrative fee may also apply.

A few seconds of impatience can put a child in danger and lead to a court case, fines, license consequences, increased insurance costs, or potential jail exposure.

Slow down. Watch for flashing red lights. Stop completely. Protect our students.

You’re not alone if your current custody or visitation order no longer fits your child’s needs or your family’s circumstances.

In Virginia, a parent seeking a modification generally must prove two things:

• There has been a material change in circumstances since the last order.
• The requested change is in the child’s best interests under Va. Code § 20-124.3.

Examples of a possible material change may include:

• A relocation that affects parenting time or transportation
• Significant changes in a parent’s work schedule
• A child’s changing developmental, educational, or medical needs
• Persistent non-compliance with the existing order

An informal agreement between parents does not legally change a court order. Even if you and the other parent agree by text, email, or conversation, the existing order may still be enforceable until a court formally modifies it. Avoid self-help, such as withholding visitation or changing exchanges without legal guidance.

A formal petition to modify custody or visitation should be filed in the appropriate court, often the Juvenile and Domestic Relations District Court. The process and evidence matter.

If your family’s circumstances have changed in Virginia Beach, Hampton Roads, or elsewhere in Tidewater, Coastal Virginia Law can help you understand your options. Schedule a free consultation at www.coastalvirginialaw.com.

Navigating a divorce while sharing a roof can feel overwhelming. In Virginia, financial constraints or family considerations often require couples to remain "separated in place" under the same roof while initiating divorce proceedings.

However, living separately under one roof comes with strict legal requirements regarding continuous separation, evidence of separate lives, and protecting your rights during the transition. Documenting the exact date of separation and maintaining clear boundaries is critical when establishing grounds for divorce in Virginia Beach and the Hampton Roads area.

You don't have to navigate these complex living arrangements alone. Coastal Virginia Law provides personalized legal representation tailored to your unique situation, helping you understand your rights and protect your financial and parental interests from day one.
