Why spousal support in Virginia is hard to put a number on

Virginia law asks the support question twice.

Which court? Support can be ordered in the JDR District Court without a divorce filing, or in the Circuit Court as part of a divorce. The courts share jurisdiction, but once a divorce action is filed and a hearing is docketed, the JDR court is divested of jurisdiction.

Temporary or final? Temporary (pendente lite) support follows a presumptive formula — presumptive means rebuttable, not automatic. The final award is different: the court weighs the statutory factors, which come down to need and ability to pay, alongside marriage length, earning capacity, and standard of living.

Note: the temporary number has no presumptive effect on the final award. An early figure is not a preview of the ending.
