In a message to the Smyth County Sheriff's Department, Smyth County Commonwealth Attorney Phillip Blevins called Virginia's assault weapon ban "unconstitutional."

In the message, Blevins says, that after careful review of the legislation and existing Supreme Court precedent that he finds the assault weapon ban that was signed by Governor Spanberger on May 15 to be unconstitutional and unenforceable.

Blevins says that his oath "requires more than mechanical enforcement of statutes." Blevins goes on to say "I must exercise prosecutorial discretion, constitutional judgment, and fidelity to the rule of law."

Blevins says that his office will not support criminal charges resulting solely from technical violations of the ban.

Blevins makes clear in the message that "this position does not extend to violent offenders, prohibited possessors, drug traffickers, gang-related offenses, or individuals using fi****ms in furtherance of criminal activity."

Apparently, there was a shooting at the VB Oceanfront tonight (4/11). I predict, in less than 24 hours, the VB Police Chief will issue a statement blaming the fi****ms instead of the upstanding young men that are actually responsible for the violence.

This is like one of those songs where, after you hear the first two lines of the first verse, you can pretty much sing the notes for the rest of the song. Good ‘ole Chief Neudigate has been singing so well for the past few years, I think I can figure this one out on my own.

Random thoughts to share: I’ve been to a LOT of courthouses in Virginia. The courtrooms in Fauquier Circuit Court are, by far, the most bizarre I’ve seen. They are vaguely reminiscent of the courtroom in the Harry Potter movies, complete with highly elevated galleries, a fish-bowl-like well for trial participants, and an incredibly steep staircase for getting down to the well. Whoever designed those courtrooms thought they were pretty clever. (They were not, in fact, pretty clever.)

In related news, I did the gun rights thing today. Happy client; happy attorney. TGIF.

This is a reasonably accurate and mostly thorough article about purchasing a firearm while being a “user of or addicted to” drugs. They even reference a fairly recent case out of Newport News. Noticeably missing, however, is the most (in)famous conviction for the same offense: Hunter Biden. Although, to be fair, his drug choice was the good ole’ Colombian Marching Powder and its crystalline equivalent.

A Virginia Beach man faces multiple charges including accusations that he provided false information about his ma*****na usage when purchasing fi****ms.
