Fishing off a public highway. Legal? We wouldn't bet on it.

Virginia follows pure contributory negligence.

In plain terms: if you're found even partly at fault for your own injury or damage, you may be barred from recovering anything.

Driving into a flooded roadway is exactly the kind of decision that can come back to hurt a claim.

All 18 felony charges against Matheus Cavalcante have been dropped.

The evidence showed that Matheus was the target of an attempted armed robbery and fired in self-defense. We made the argument the evidence was insufficient for a finding of guilt; the Commonwealth moved to drop the charges, and the court granted the motion.

"As I said at the outset, Matheus is a good kid from a good family. He acted in self-defense. This was an unfortunate and dangerous situation, and there was an attempted robbery of my client. Through the available evidence, we were able to show what really took place. The decision to drop all 18 felony charges is the right outcome. Justice prevailed, and Matheus can now move forward with his life.” — Diane Toscano, Toscano Law Group

A rare federal court victory.

Toscano Law Group secured the permanent dismissal of all charges against our client in a federal criminal case in the Eastern District of Virginia. The court found a Speedy Trial Act violation and a “pattern of neglect” by the government.

“Federal prosecution is one of the most powerful tools the government has,” said Diane Toscano. “Our job is to make sure that power is tested at every step.”

Dismissed with prejudice means the federal government cannot bring the same charges again.

Virginia federal criminal defense attorney Diane Toscano helped secure the permanent dismissal of all charges in a rare federal Speedy Trial Act ruling.
