Keep in mind this holiday season… If you’re pulled over for a DUI, not every test an officer asks you to take is mandatory. You have the right to refuse a few things in Illinois, such as:

1. Field Sobriety Tests
Including: the walk-and-turn, one-leg stand, and the eye test are 100% voluntary. (Officers often don’t tell you that.)

2. Roadside Breath Test (PBT)
This is the handheld breath test at the scene, and is not not the official test used to record your BAC. Refusing it does not trigger an automatic license suspension.

3. Chemical Testing (After Arrest)
If you are arrested and brought in to the station, you can refuse the station breath, blood, or urine test… but refusal triggers a Statutory Summary Suspension starting 46 days after the arrest.
(First offense: 12 months)
(Repeat offenders: 36 months)

Every situation is different. By refusing to take these tests, it may weaken the State’s case, but it can also impact your license. Before making any decision, get legal guidance.
