Офицеров USCIS наделили правом принимать решения по делам иммигрантов «на свое усмотрение».

Данное решение несомненно осложнит иммиграционный путь многих. Оно опасно тем, что если определенное государственное агентство, такое как USCIS, наделено правом принимать решения по делу "на свое усмотрение", негативное решение принятое в порядке усмотрения не подлежит пересмотру в федеральном суде.

То есть, концепция "на свое усмотрение" может применяться как положительно, так и отрицательно и никакой федеральный суд не может вмешиваться в то как это "усмотрение" было применено.

Иммиграционные процессы и без того стали намного жестче. Сейчас, как никогда, важно не рисковать, подавая иммиграционные петиции самостоятельно, без помощи специалистов.

Take action to protect asylum!

Immigration Justice Campaign has prepared a model comment (https://www.aila.org/takeaction#/82) that allows the public to easily and quickly submit a comment opposing the June 15th proposed rule that seeks to make multiple changes to the procedures for asylum, withholding of removal, and protection under CAT.

To date, more than 34,000 comments have been submitted to the government on the proposed rule. The government must review and respond to each *unique* comment before finalizing and implementing the rule. Hence, the more personalized comments the government receives the longer it will take for it to be implemented.

Almost 3,000 comments have been submitted through AILA’s model comment campaign (which is included in the 34,000 submitted in total to the government). AILA needs your help in reaching its goal of submitting 4,000 comments by its portal.

LPR Applicants, Their Sponsors, and Immigrant and Civil Rights Groups Sue Over Law Violations in Implementation of Trump Administration’s Public Charge “Wealth Test"

On July 13, 2020, applicants for lawful permanent residence, their sponsors, nonprofit immigration legal service providers, and immigrant and civil rights groups sued the Trump administration for violating the law in its implementation of the new “public charge” regulation, alleging that the new guidance goes further than the regulation itself to exclude individuals who merit admission to the United States.

AILA Director of Federal Litigation Jesse Bless said, "The administration took a discriminatory and terrible regulation … and made it even worse through the [USICS Policy Manual] and overreach for the information included in the new Form I-944."

The plaintiffs claim that the guidance contains a complex and contradictory set of policies designed to unlawfully and arbitrarily prevent all but the wealthiest of immigrants from becoming lawful permanent residents.

Diversity Visa Winners File Complaint Arguing the Trump Administration Unlawfully Suspended the DV-2020 Program

A group of 226 Diversity Visa program selectees and their families from over 65 countries filed a complaint in district court arguing that the Trump administration has suspended the DV-2020 program through policies, procedures, and practices that are contrary to the INA and federal regulations governing the program.

Exemptions for nonimmigrant students taking online courses during fall 2020 are removed. Students must enroll in on-site classes or be forced to leave the country.

WASHINGTON – The Student and Exchange Visitor Program (SEVP) announced modifications Monday to temporary exemptions for nonimmigrant students taking online classes due to the pandemic for the fall 2020 semester.

Temporary exemptions for the fall 2020 semester include:

1. Nonimmigrant F-1 and M-1 students attending schools operating entirely online may not take a full online course load and remain in the United States. The U.S. Department of State will not issue visas to students enrolled in schools and/or programs that are fully online for the fall semester nor will U.S. Customs and Border Protection permit these students to enter the United States. Active students currently in the United States enrolled in such programs must depart the country or take other measures, such as transferring to a school with in-person instruction to remain in lawful status. If not, they may face immigration consequences including, but not limited to, the initiation of removal proceedings.

2. Nonimmigrant F-1 students attending schools operating under normal in-person classes are bound by existing federal regulations. Eligible F students may take a maximum of one class or three credit hours online.

3. Nonimmigrant F-1 students attending schools adopting a hybrid model—that is, a mixture of online and in-person classes—will be allowed to take more than one class or three credit hours online. The above exemptions do not apply to F-1 students in English language training programs or M-1 students pursuing vocational degrees, who are not permitted to enroll in any online courses.

Due to COVID-19, SEVP instituted a temporary exemption regarding online courses for the spring and summer semesters. This policy permitted nonimmigrant students to take more online courses than normally permitted by federal regulation to maintain their nonimmigrant status during the COVID-19 emergency.

USCIS is extending the flexibilities it announced on March 30, 2020, to assist applicants and petitioners who are responding to certain:

Requests for Evidence;
Continuations to Request Evidence (N-14);
Notices of Intent to Deny;
Notices of Intent to Revoke;
Notices of Intent to Rescind and Notices of Intent to Terminate regional investment centers;
Filing date requirements for Form N-336, Request for a Hearing on a Decision in Naturalization Proceedings (Under Section 336 of the INA); or
Filing date requirements for Form I-290B, Notice of Appeal or Motion.

This flexibility applies to the above documents if the issuance date listed on the request, notice, or decision is between March 1 and Sept. 11, 2020, inclusive.

USCIS will consider a response to the above requests and notices received within 60 calendar days after the response due date set in the request or notice before taking any action. They will consider a Form N-336 or Form I-290B received up to 60 calendar days from the date of the decision before they take any action.

Trump administration plans to extend and to modify the executive order signed in April 2020 barring some immigration to the US.

The following visas are under consideration to be suspended: L-1, H-1B, H-2b, J-1.

Government is Considering Suspending OPT for Students

The Trump administration may suspend OPT, a program for foreign students to stay in the U.S. to get 1 or 2 years of occupational training after their education. This measure will drastically restrict student’s options after graduation. The businesses actively hiring foreign travel already expressed their concerns about not being able to hire young talent.

OPT, is certainly an incentive for foreign students to come and pay for education in the U.S., which is no secret very expensive compared to other countries. So, the revenue to colleges and universities would decrease as well, another detriment to the US economy.

USCIS IS SET TO IMPOSE 10% COVID-19 FEE INCREASES ON ALL NEW APPLICATIONS FILED

There has been a marked decrease in the number of applications being received by the USCIS for immigration benefits. Consequently, the agency has experienced a shortfall in its principal source of revenue; application filing fees. To offset some of their lost revenue, the agency is set to impose a 10% surcharge or increased fee on all new applications filed. This will be in addition to the new fee increases proposed by the Service immediately before the pandemic outbreak.

Коротко о главном: Исполнительный указ президента Дональда Трампа. Кого же он все же затронет, а кого нет?

22 апреля 2020 президент подписал обещанный исполнительный указ, который входит в силу 23 апреля 2020 в 23:59 и будет действовать на протяжении 60 дней. Через 30 дней указ может быть пересмотрен и ужесточен, через 50 дней указ может быть изменен и/или продлен.

Итак, кого же коснется данный указ:
• Всех, кто планирует получить иммиграционную визу за пределами США на основании:

- петиции, поданной работодателем;
- выигрыша в лотерее грин-карт,
- петиции на воссоединение, поданной детьми-гражданами США, обладателями грин карты для их родственников и петиции на воссоединение, поданной для братьев и сестер граждан США.

Выдохнуть можно тем, кто не попадает в список выше, а именно тем, кто:
• подает петиции на воссоединение;
• уже получил иммиграционную визу или грин карту;
• подает на грин карту на территории США;
• подает на смену статуса на территории США;
• оформляет иммиграционную визу, являясь супругом или несовершеннолетним ребенком гражданина США;
• хочет получить неиммиграционную визу или уже имеет её (B1/B2, F1, E-2, H1-B, O-1, L-1, etc.);
• имеет Advance Parole;
• является военнослужащим или супругом, ребенком военнослужащего;
• нуждается в убежище;
• является работником здравоохранения и агрикультурной отрасли;
• является заявителем по национальным интересам;
• подает на снятие условности с грин карты или продлевает грин карту;
• проходит по программе EB-5 и т.д..
