This was an Essex County Domestic Violence case that was tried over the course of a few months. There was also contempt trial where the State alleged our client violated that restraining order.

Not only did the Judge dismiss the restraining order after a trial, but a different Judge found our client not guilty of contempt for the alleged violation.

This is Azah. Azah and I have been working together for 18 months. He has been sitting in the Essex County Juvenile Detention Center on a homicide charge for those 18 months. From day 1, okay maybe day 10, I knew Azah was innocent. It took 18 months, but we finally got his charges dismissed last week. It was a VERY scary process for him and his family. The Prosecutor from the Homicide Unit filed a waiver- this means he could have been tried as an adult and sentenced as an adult. However, I was able to convince the Prosecutor that my client was innocent and to dismiss the charges against him. This was the right and just outcome. Azah’s life will never be the same, but now he has a future ahead of him. This is why I love what I do. This is why my job is so rewarding. His smile says it all. Azah, as I tell my kids every morning, be great! I know you will be!!!

In 1981, the Graves Act was established by the former Mayor of Paterson. Originally there was a minimum term of imprisonment of 3 years if convicted of committing a crime with a firearm. However, in 2008 the NJ Legislature expanded the Act to include more offenses like, possession of a firearm, sawed-off shot gun possession, defaced firearm, and so on. Now the minimum is 42 months NJ State Prison before being eligible for parole. Even if your firearm was legally purchased in another State, if caught with a firearm in NJ, your case will fall under the Graves Act. A BB gun is also a firearm under the statute! Not to mention, your prior criminal history, including being a convicted felon, can raise the minimum time up to 5 years NJ State Prison.

Until April 2021, Courts were required to impose a parole disqualifier where defendants had to serve at or between, one-third and one-half of the sentence imposed by the Courts on non violent drug offenses. However, for many reasons, including racial disparities, the Attorney General guidelines disposed of these mandatory minimums. I have been filing motions to release our clients that have been held on these mandatory parole disqualifiers. This is one step our legal system has taken to try to fix some of the many flaws in the system.

An attorney in the State of New Jersey was suspended from practicing law for 3 months for possessing Adderall without a prescription. The attorney told the disciplinary board that he was not a drug addict, and that it is widely used in college and law school without a prescription. The attorney plead guilty and received a diversionary program for 24 months. Once it’s completed, it can be expunged and removed from his record. Follow us on insta
