If you answered true you are not alone. This is one of the most common estate planning misconceptions we come across and it is worth understanding before it becomes an issue for your family.

A will is an essential part of any estate plan. It documents your wishes, names your beneficiaries, and designates who is responsible for managing your estate. However a will does not bypass the probate process. In Florida a will must still be submitted to the court and go through probate administration before your assets can be distributed.

There are planning tools that may help reduce or avoid probate including a revocable living trust, properly designated beneficiaries on accounts and insurance policies, and transfer on death or payable on death designations.

If you have a will and assumed your planning was complete it may be worth scheduling a review to make sure your estate plan is structured in a way that truly reflects your goals and protects your family. We would be happy to help. 💙

When a child has a disability estate planning becomes about so much more than dividing assets. It becomes about making sure they are protected, supported, and cared for long after you are gone. 🤍

A standard estate plan was not built with your family in mind. Leaving assets directly to a loved one with a disability even with the best intentions can unintentionally disqualify them from the government benefits they depend on like Medicaid and SSI.

That is why families in this situation need a plan that goes further. One that includes a Special Needs Trust to preserve their benefits, guardianship advocacy to protect their legal rights, and careful coordination of every document to make sure nothing falls through the cracks.

This is one of the most meaningful areas of our practice and one we approach with a great deal of care and intention. 💙

When did you last review your estate plan?

Most people create an estate plan and assume it will take care of itself. But life changes and when it does your estate plan should change with it.

Getting married or divorced, having children, purchasing property, starting a business, or experiencing a significant shift in your finances can all affect whether your existing plan still reflects your wishes and protects the people you care about.

Beyond personal changes the law itself can change. Florida statutes and federal regulations that affect estate planning are updated periodically and a plan that was structured correctly a few years ago may benefit from a review.

Reviewing your estate plan every three to five years or after any major life event is a reasonable way to make sure your documents remain accurate and your plan is still doing what you intended it to do. It does not have to be a lengthy process but when updates are needed catching them early can make a meaningful difference for your family. 💙
