You got the Petition filed with the court, now what?

Serving divorce papers to your ex-spouse can be challenging but is a crucial step. Along with the filed forms you received from the court (Petition, Summons, and Declaration under UCCJEA if there are kids), make sure you also include a blank Response and Request for Dissolution/Legal Separation (FL-120) and a blank Declaration under UCCJEA (FL-105) if you have kids.

Someone over 18 (not you) must personally serve them the documents. You can use the Sheriff’s Civil Department or a private process server. If you and your ex are on friendly terms, they can also accept the documents by mail. Just be sure they sign the Notice and Acknowledgement of Receipt (FL-117).

Finally, and I cannot stress this enough, please make sure you file the Proof of Service of Summons (FL-115) so the court knows that you have served your ex!

Remember, stay calm, and follow the legal process to move your case along.
