Tara Alden is a Paralegal at the Schlotfeldt Law Firm. She started her legal career as an intern at the Modoc County Superior Court while working on her bachelor's degree in Paralegal Studies and Public Administration. Tara has since worked in a variety of legal fields, including Domestic Relations and Personal Injury in Oregon. She is now assisting attorneys with Business, Real Estate, and Construction Law in both Oregon and Washington. Outside of the office, Tara is an avid hiker and photographer who also enjoys painting, gardening, jiu jitsu, and gaming. Just like in her personal life, Tara enjoys taking on diverse challenges. She quickly adapts to provide effective and efficient support to the firm and our clients.

Zoe Saccio is a J.D. Candidate at Lewis & Clark Law and holds a bachelor’s degree from Simon Fraser University. She currently serves as the Student Liaison to the Washington Supreme Court Gender Justice Commission, on the board of Environmental Law Review, and is the VP of Student Affairs at Lewis & Clark Law School. Before her career in law, Zoe was a national championship medalist in track cycling and competed as a professional road cyclist. Just like in her athletic career, Zoe enjoys her work and strives for excellence at the Schlotfeldt Law Firm.

Noach is an attorney at the Schlotfeldt Law Firm where he is engaged in a wide variety of construction, real estate and business litigation matters as well as breach of contract and construction defect cases. Prior to joining Schlotfeldt Law Noach practiced at Lorber, Greenfield & Polito, and Sheer Law Group, both in the Seattle area, where he handled construction law matters and tort claims. Having worked on both sides of the aisle, Noach brings a unique insight into his current practice and is able to work cooperatively with both co-counsel and opposing counsel. He further understands that every client’s needs and goals are different and provides a tailored approach to accommodate each respective
client.

He has appeared in administrative hearings and represented Kent Municipal as a Rule 9 Prosecutor in civil bench trials. Noach’s experience further includes drafting dispositive motions, managing pre-trial discovery and production in highly detailed cases, examining witnesses at deposition and he zealously represents his clients throughout the litigation process.

Residential and Commercial Landlords:

On Friday, April 17, 2020, Governor Inslee signed Proclamation 20-19.1 extending the current moratorium on evictions through at least June 4, 2020. The order also continues the prohibition against delivering a notice of termination to any tenant- treating nonpaying tenants and tenants with expired leases alike.

HOA and COA Clients:

On Friday, April 17, 2020, Governor Inslee signed Proclamation 20-51 potentially impacting Washington's 2.1 million residents living in community associations. The Order allows all Associations, regardless of contrary provisions in the CC&Rs/Bylaws, to handle business (including member meetings, board meetings, and voting) remotely. In person meetings remain prohibited outside of extenuating circumstances.

The Order also prohibits Associations from assessing or collecting fines, late fees or costs for unpaid association dues until the Order expires.

The most frequent question we're fielding from small business clients is: can I apply for both the Economic Injury Disaster Loan (EIDL) and the Paycheck Protection Program?

According to the SBA: Borrowers can apply for both an SBA Economic Injury Disaster Loan (EIDL) and the Paycheck Protection Program loan. However, the Paycheck Protection Program loan funds and the Economic Injury Disaster Loan funds cannot be used for the same purpose. The Paycheck Protection Program loan must be used for payroll (minimum of 75% of the funds received) for it to be eligible for a forgivable loan and the remaining is used for different purposes. Borrowers who accept both loan funds should document the uses of the funds appropriately.

We continue to hear from our developer clients seeking guidance on Governor Inslee’s March 23, 2020 Order as it relates to general construction services. The Governor issued a memorandum clarifying his earlier Order and pursuant to it, general residential and commercial construction IS NOT an essential activity in Washington at this time. While there are a few exceptions to the rule, job sites must be secured and all construction ceased until the Order has been lifted.

Albert has more than 30 years of professional legal experience, with the majority of emphasis placed in construction, commercial leasing and real estate. He specializes in public works and private construction projects, in which he advises public entities, commercial contractors, developers and individuals in all aspects of the construction process.

Rachel represents individual and business clients in a wide range of transactional and litigation matters including real estate, corporate, commercial and construction law. She is highly skilled in handling complex legal and factual matters and gears her practice towards reaching efficient resolution. In addition to providing first-class legal representation, Rachel focuses on providing responsive representation and connecting with her clients.
