A Washington driver crashes in Oregon. Which laws apply?

If you live in Washington but are involved in a crash in Oregon, or vice versa, you may have laws from both states come into play.

Here’s why:
📍 The laws where the crash happened can apply to the accident itself and negligence
📑 Your insurance contract is generally tied to the state where you live
⚖️ PIP and underinsured motorist claims can involve additional questions under your home state’s laws
🏛️ If you need to file a lawsuit, it will generally be filed where the accident happened

🎓 Submitted his report card for a good-grade discount
📱 Set up my insurance company’s driving app

Renting a car? Don’t pay for extra insurance until you check your policy. 💰

I love renting a car when I travel, so this is something I think about personally, too. Before paying for additional coverage, check what protection you already have. 👀

📑 Personal auto policy: May extend coverage to rental cars.
💳 Credit card: May offer secondary or primary rental coverage.
⚖️ The gap: Rental insurance may cover things like loss of use or diminished value.

Whether it’s worth the extra cost depends on your existing coverage and how much risk you’re comfortable taking on.

My son just got his first car, and his car crash lawyer mom has thoughts. 😅🚗

He turned 16 in August and found himself a 2010 Hyundai Sonata with low miles that he is SO proud of. Getting him to his drive test on time was its own adventure (we may have had to reschedule once 😂), but we got there.

As excited as I am for him, I see the other side of the road every day. So before he drove off, we went over the basics together:

It really does take a village. ❤️

Meet Granny K, my mom and a very important part of my village.

Before civil trials, I fly her in to help with the kids so I can focus on everything that goes into preparing for trial. Between school drop-offs, meal prep, driving the kids around, and all the everyday things, there’s a lot to juggle!

She’s come from Michigan and Arizona to help us, and I’m so grateful to have her in my corner. 🥰

I love w**e tasting, but I definitely don’t love driving after. So what happens if an Uber or Lyft gets into a crash? 🍷

It can get a little complicated depending on who caused the accident and what insurance coverage is available.

🚗 If your Uber or Lyft driver caused the crash, their insurance may provide coverage.

🛡️ If another driver caused the crash, their liability insurance may apply first.

📑 The rideshare company’s coverage, including potential PIP or underinsured motorist coverage, may also come into play.

📹 And don’t forget to ask the driver about dashcam footage. That evidence can be important and may not be available forever.

A little throwback to the time I went back to Tucson, Arizona, for my 30th class reunion. 🌵

I grew up in Tucson, so going back always brings back a lot of memories.

It was fun to spend a few days back in the desert, reconnect with old friends, and revisit a place that will always be a part of my story. ❤️

And yes, a 30th class reunion definitely makes you feel a little old. 😂

You were hit by an uninsured driver. Now what? 🧐

In Washington, roughly 1 in 6 drivers are uninsured, so knowing your options matters. 👀

I’ve seen firsthand how difficult an injury claim can become when the at-fault driver has no insurance and there’s no UIM coverage available. 🚗

If the at-fault driver has no insurance, we may look at:

🔍 Other sources of liability: Road defects, rideshare companies, or the vehicle owner.

⚖️ Your UIM coverage: Your own Uninsured/Underinsured Motorist coverage may be your main source of recovery.

📑 Your coverage limits: Washington's basic UIM limits start at $25,000 per person / $50,000 per accident and can go higher.

Washington allows drivers to waive UIM coverage. If you do, you may have very limited options after an uninsured driver causes a crash.
