BETH KUZMOVICH WINS SEXUAL ASSAULT PROTECTION ORDER AGAINST HOLIDAYS ON FRANKLIN FOUNDER JIM MAINS
Vancouver, WA - Yesterday, Elizabeth Kuzmovich prevailed in her request for a Sexual Assault Protection Order (SAPO) against Holidays on Franklin founder James William Mains.
In the court's findings, Judge Nancy N. Retsinas stated: "The court will enter a 3 year sexual assault protection order...The court finds by the preponderance of the evidence that Ms. Kuzmovich proved the specific act of nonconsensual sexual conduct identified in the written findings. The court found her testimony concerning that act more credible than Mr. Mains' response to the allegation."

“Today is about more than one court order. It’s about courage. It’s about every survivor who has ever been told to stay silent, every woman who has endured sexual assault, and every person who has struggled to find justice after trauma,” said Tammy Graham, NWCAVE’s Director of Victim and Survivor Services.
“Beth stood up. She endured hate, threats, and lies throughout this process. She reminded us that there is no expiration date on trauma—and that healing does not follow a calendar. Her courage also means that the evidence presented in court and the statements submitted by other individuals remain part of the public record,” said Graham.
“This is a reminder that survivors deserve to be heard, believed, and supported. It is a reminder that speaking out can protect others and help prevent future harm. Crime victims and survivors should never have to work this hard to be seen and heard,” said Michelle Bart, NWCAVE Founder.
As the holidays approach, let us remember the women and survivors whose voices have too often been ignored. To every survivor: We see you. We hear you. We stand with you.
And to Beth: Thank you for standing up—not just for yourself, but for so many others.
Please note: The court's ruling described above reflects the findings in the sexual assault protection order proceeding and the applicable civil standard of proof.
