For a highlight of trademark takeaways from the Four Seasons political event, you can read Francesca M. Witzburg, Esq.'s article published in the International Trademark Association (INTA) Bulletin, https://bit.ly/3nuJRSQ

Since Nov. there have been some interesting consequences from the event, including the sale of masks and Christmas sweaters with the landscaping company’s logo, an artist’s satirical rendition of the shirts, and a petition to make the landscaping location a historic site. The same trademark may be used for unrelated categories. But considering a recent U.S. presidential press conference held outside Four Seasons Total Landscaping, is it enough to simply say the categories are unrelated and therefore confusion is unlikely?

Fanciful marks do not describe the good or service to which they relate and also happen to be the most likely marks to register. In other words, if a mark does not give indication what the goods are then it has a higher chance at registering. The downside, of course, is that the customer knows nothing about the goods so you need to educate the consumer more. Famous example - the APPLE trademark for computers.

On this (also ), we had to look up whether there were any trademark rights associated with the source, GivingTuesday, an independent nonprofit organization. We did not find any but ultimately, the organization's goal is "to create a more just and generous world, one where generosity is at the heart of the society we build together, unlocking dignity, opportunity, and equity around the globe."

The logo treatments change every year and can be used freely by other organizations without permission. And, for those very reasons, cannot be trademarked. Trademarks need to be controlled by the source AND used consistently and continuously in commerce.

Checked out the USPTO for pending and registered Thanksgiving related marks for this week! Our favorite pending mark is THANKSGIVING PIE FIGHT to Food Network in connection with "Entertainment services in the nature of an ongoing non-fiction television and multimedia program distributed via various platforms across multiple forms of transmission media; providing entertainment information to others via a global computer network."

As Thanksgiving is so different this year, a pie fight definitely feels in order, right? Happy Thanksgiving - eat (or throw) the pies, be grateful for health and found time, enjoy your people in the safest way possible!
