A lot of people assume that once a trust is signed, it's set in stone. But that's not always true. In California, trusts CAN be contested and it happens more often than you might think. Common reasons someone might challenge a trust include:

✳️ A family member believes the grantor wasn't mentally capable when they signed

✳️ There's evidence of undue influence (a caregiver, new partner, or relative pressuring the grantor)

✳️ The trust wasn't properly executed under California law.

If you've recently been notified of a trust, pay attention to the timeline. California law generally gives you 120 days from the trustee's written notice to file a contest.

Quick estate planning tip that could save your family a lot of time and stress: Does your bank account have a named beneficiary?

If not, that account could end up going through probate when you pass, meaning your loved ones may have to wait months (and spend money on court fees) just to access the funds.

The fix is simple: ask your bank to add a Payable on Death (POD) beneficiary to your account. It's free, takes just a few minutes, and means the money goes directly to your chosen person, no court, no delays.

In California, any account held in your name alone with no beneficiary designation is generally subject to probate. Joint accounts with right of survivorship are a different story. Those typically pass automatically to the surviving owner. Small changes like this are exactly the kind of thing a good estate plan takes care of.
