Don't compound a mistake by giving away all your 5th Amendment rights against self-incrimination. And yes, you can refuse to take the field sobriety tests, and you should refuse.


Why give them all the evidence that they're gonna use against you in court? DUI is the only case where people give up their 5th Amendment rights and voluntarily give the cops everything they need for a conviction.

Please note that it's also *Roadblock* season, which means open season on you as a driver. If you approach a roadblock, do it slowly with your license, insurance, and registration ready. Know this, if they smell alcohol, you're going to jail no matter what they say to you. They will imply that they might not arrest you. They will try to coerce you to surrender your 5th amendment rights against self-incrimination. So refuse to take the field sobriety tests (...you couldn't pass those completely sober). Also refuse all breath tests, unless you've only had one normal drink or less.

DUI is the rare criminal case where a driver basically becomes the only witness against himself or herself.

So don't do that.
