🚨 TPD will be doing a DUI checkpoint around downtown Tulsa this weekend 🚨

If you enter the checkpoint, be polite to the officers. You have the right to refuse Field Sobriety Tests (like the walk and turn and the eye test) and the States Test (the official breath or blood test). Remember: if you don’t know, don’t blow - a higher BAC can result in your DUI arrest being charged as a felony. As always, be safe and have a plan to get a ride home if you’re going to be drinking.

DUI CHECKPOINT đźš”

Temperatures look like they’ll be (slightly) cooler this weekend, so it’s a great time to get out of the house!

We’ll be set up downtown this Saturday night to make sure everyone is enjoying themselves responsibly.

If you’re drinking, please arrange a safe way to get to and from downtown, and don’t bring anything with you that you shouldn’t.

Does a scooter fit in the trunk of a squad car? An electric scooter is still a motorized vehicle, which means you'll get the same DUI charge as you would driving a car if you drink and ride one 🙅‍♂️. Don't find out the hard way - hoof it to the next bar if you've had a few.

If you're under 21, you can't even sniff a b**r and drive. That's because if you're a minor, ANY detectable amount of alcohol in your system can result in a DUI. Your safest bet is always to get a ride home. If you are driving and get pulled over:

1) Politely refuse to answer questions
2) Refuse field sobriety tests
3) Refuse the breathalyzer

Legally prescribed ≠ legal to drive.

OK DUI law makes no exceptions for whether a drug was prescribed legally or not. The only standard is whether the drug is an "intoxicating substance ... which may render such person incapable of safely driving or operating a motor vehicle."

We've seen cases involving legally prescribed Xanax, Ritalin, cough syrup for the flu - you name it. If you're on a drug that could be considered an intoxicant, you can get a DUI at any time.

Don't consent to a police search of your vehicle.

"I'll just have a quick look" -> No thank you, I don't consent to a search.

"you don't have anything to hide right?" -> No thank you, I don't consent to a search.

"We'll have to wait for a K-9 unit" -> No thank you, I don't consent to a search.

You have nothing to gain from consenting to a search. Don't do it.

What do these crimes have in common with DUIs?

1) Domestic Assault with a dangerous weapon
2) 1st degree Forgery
3) Selling 10 or more phone records without authorization
4) Arson
5) Drug Trafficking

Aggravated DUI and all the crimes above are in the exact same sentencing category (Felony - B3) under Oklahoma's new sentencing law.

Are any of these crimes alike? No. But, do they have similar sentencing ranges? Also no.

If you're arrested for DUI, one of the first things you should do is update your address. Seriously.

After a DUI, Service Oklahoma (formerly DPS) will mail you a letter revoking your driver's license. If your old address is what's on file, you won't get it, and you won't be able to appeal your revocation. If you can't appeal, your only option to keep your license is to complete IDAP (and have a breathalyzer in your car).

There are four levels of Blood Alcohol Content (BAC) in Oklahoma ->

1) 0.00 - 0.05 BAC: Legal (with some exceptions)
2) 0.06-0.07 BAC: DWI; The State must also prove that your driving was impaired
3) 0.08 - 0.14 BAC; Regular DUI; You're going to jail tonight. Misdemeanor.
4) > 0.15 BAC; Aggravated DUI; You're going to jail for a few tonights. Felony.

If you don't know, don't blow. A higher BAC test might make things worse.
