We are seeing the first AI-drafted patent applications reach prosecution, and one defect keeps repeating.

Under 35 U.S.C. 132 you cannot add new matter after filing. Claims can be narrowed. The specification is the ceiling, and the ceiling is set the day you file.

AI writes fluently about the embodiment you described. It does not know what your competitor will ship in three years, so it does not describe the alternatives. You find that out when an examiner cites prior art and there is nothing in your own spec to fall back on.

A patent application is not a form. It is a technical document with legal consequences in every sentence.

The specification teaches how to build the invention. The drawings show it. And the claims, the numbered sentences at the end, define exactly what you own. Everything else supports the claims.

That means if two inventors independently create the same invention, the patent goes to whoever filed first, not whoever invented first. Your lab notebook proves diligence; it does not win the race.

The practical rule: when the invention is ready to describe, it is ready to file. A provisional application locks your place in line for a modest cost.
