Did you know the Oklahoma State Board of Agriculture can search your bags, packages, and containers? Here’s where that authority comes from.

Under Oklahoma law, Title 2, Section 2-14, the State Board of Agriculture and its agents have authority to conduct investigations and search agricultural products, containers, and so forth to make sure Oklahoma’s agriculture codes and laws are followed.

And if an individual denies the Board’s agents access to those packages or anything else during the course of an investigation, the Board and its agents are allowed under Oklahoma law to obtain a warrant through the district courts.

If you do get an attorney and they’re able to come up with a plea agreement, you can either plead guilty or no contest. There’s not a whole lot of difference in outcomes between the two. The main difference is what you’re actually pleading to.

You've heard "beyond a reasonable doubt" in every courtroom drama. But what does it actually require, and why does it matter so much?

Attorney Keith Flynn explains the part people get wrong: beyond a reasonable doubt does NOT mean beyond all possible doubt, and it doesn't mean 100% certainty. Instead, it means the evidence has to be convincing enough that a reasonable person using common sense wouldn't have a real, honest doubt about a person's guilt.

And critically, this burden sits entirely on the prosecution. A defendant doesn't have to prove they're innocent. They don't have to testify. They don't have to present any evidence at all. If the state doesn't clear that hurdle, the law requires a not guilty verdict, even if the jury isn't fully convinced of innocence either. That's the whole point of setting the bar so high.
