Beginning September 18, 2026, USCIS will change how it evaluates the “public charge” ground in certain adjustment-of-status cases. The new guidance allows USCIS to consider a broader range of factors when deciding whether someone is likely to become a public charge.

This does not mean that receiving a public benefit automatically results in denial of a green card. The determination depends on the type of case and the individual circumstances, and some immigration categories are exempt from the public-charge ground.

A DUI arrest is not the same thing as a DUI conviction.

WSMV4 found that 41 DUI arrests made by one former Tennessee Highway Patrol trooper in Bedford County were dismissed. In 22 of those cases, testing found no alcohol or drugs, or showed levels within legal limits.

Un acuerdo penal no se debe analizar solamente por cuántos días de cárcel, probation o multas incluye.

Para una persona que no es ciudadana de Estados Unidos, también puede importar lo que ese acuerdo significa bajo la ley de inmigración.

For someone who is not a U.S. citizen, what that agreement means under immigration law can matter too.

The exact charge, how the case is resolved, and the sentence can change the analysis. Two plea agreements that look similar in criminal court can have very different immigration consequences.

An affirmative asylum application will not always receive a USCIS interview before being sent to immigration court.

Since July 28, 2026, USCIS may refer certain asylum applications directly to an immigration judge after reviewing the record and available evidence. This may include cases involving a potential one-year filing deadline problem, a legal bar, a discretionary issue, or apparent ineligibility.

This rule does not mean every case will be sent to court without an interview. USCIS may still schedule an interview when it determines that one is necessary.

A referral is also not a final decision on the asylum claim. The person may still submit evidence, testify, and request protection before an immigration judge.
