🟠 Si usted no es ciudadano y tiene un caso penal, no decida solo por lo que parece mejor en la corte penal.
Un cargo, un acuerdo, una declaración de culpabilidad o la forma en que termina el caso pueden afectar su situación migratoria. A veces una persona acepta una oferta porque parece rápida, porque quiere salir de la corte, o porque piensa que “no es tan grave.” Pero inmigración puede mirar el caso de otra manera.
Lo importante no es solo si hubo cárcel. También puede importar el nombre del cargo, las palabras del acuerdo, la disposición final y los documentos de la corte.
Antes de firmar, declararse culpable o aceptar una oferta, traiga sus papeles a nuestra oficina. Si tiene una citación, una orden de arresto, una oferta del fiscal, una disposición final, papeles de inmigración o recibos de USCIS, tráigalos. Mientras más completa sea la información, mejor se puede revisar el riesgo.
También dígale a su abogado penal que usted no es ciudadano. Lo penal y lo migratorio son distintos, y una decisión en una corte puede causar problemas en la otra.

🟠 If you are not a U.S. citizen and you have a criminal case, do not decide based only on what seems best in criminal court.
A charge, a plea agreement, a guilty plea, or the way the case ends can affect your immigration situation. Sometimes a person accepts an offer because it seems quick, because they want to get out of court, or because they think “it is not that serious.” But immigration may look at the case differently.
The issue is not only whether there was jail time. The name of the charge, the wording of the agreement, the final disposition, and the court documents can also matter.
Before you sign, plead guilty, or accept an offer, bring your papers to our office. If you have a citation, an arrest warrant, an offer from the prosecutor, a final disposition, immigration papers, or USCIS receipts, bring them. The more complete the information is, the better the risk can be reviewed.
Also tell your criminal lawyer that you are not a citizen. Criminal law and immigration law are different, and a decision in one court can create problems in the other.
