U.S. Citizenship and Immigration Services (USCIS) has released today a revised version of the Form I-9. Changes to the form include a reduction of Sections 1 and 2 to one page and a checkbox for employers who areenrolled in E-Verify to indicate that they have remotely examined the identity and employment authorization documents of a prospective employee under a newly authorized alternative procedure. Employers can continue to use the previous version of the Form I-9 through Oct. 31, 2023. After that date, all employers must use the new Form I-9, which is currently set to expire on July 31, 2026.

The Sixth Circuit has adopted a new test for FLSA Collective Actions.

The Sixth Circuit U.S. Court of Appeals has become the second circuit court to reject a more lenient standard used generally by federal judges to determine whether to certify wage-and-hour collective actions pursuant to the Fair Labor Standards Act (FLSA). The Court established a new, higher evidentiary standard that workers must meet when seeking to resolve their claims as a group (collectively) rather than individually, in alleged FLSA actions.
