Important update regarding Public Charge grounds of inadmissibility.
On August 18th USCIS announced a change in how its officers can make Public Charge Inadmissibility Determinations during Adjustment of Status (green card) interviews.
USCIS Officers will be able to consider the following factors:
- Applicant's age;
- Health;
- Family status;
- Assets, resources, and financial status; and
- Education and skills.
Affidavit of support may be considered, but will not be treated as a determinate factor.
To make public charge inadmissibility determinations, USCIS officers will consider the factors above and any other relevant factors to assess the alien’s likelihood at any time of becoming a public charge, including the alien’s receipt of means-tested public benefits, such as cash assistance for income maintenance, housing assistance, food stamps, financial aid for college, or any other similar benefit.
For means-tested public benefits received before Sept. 18, 2026, USCIS will only consider the alien’s receipt of public cash assistance for income maintenance and long-term institutionalization at the government’s expense.
For means-tested public benefits received on or after Sept. 18, 2026, USCIS consider any and all benefits.
USCIS will review all relevant evidence in an alien’s record and make case-by-case decisions in the totality of the alien’s circumstance.
Public Charge Bonds
If a USCIS officer finds that a person applying for adjustment of status is inadmissible only because they are likely at any time to become a public charge, the USCIS officer may invite the applicant to post a public charge bond.
A public charge bond is a financial guarantee where individuals or companies pay a cash bond with USCIS as an assurance that the alien will not become a public charge.
If the alien posts a bond in compliance with the form instructions and the notice issued by the USCIS officer, the USCIS officer may approve the alien’s application for adjustment of status, which makes the alien a lawful permanent resident and allows him or her to remain in the United States.

14 августа USCIS продлила разрешение на работу для украинских граждан, которые находятся в процессе ожидания продления TPS (статус временно защищенных лиц). Продление действительно до 19 октября 2026 года.

USCIS is extending through October 19, 2026 work authorization for Ukraine Temporary Protected Status (TPS) EAD renewal applicants who remain eligible for TPS but have not yet received their renewal employment authorization documents (EADs).

The agency is sending notices of the extension to affected beneficiaries.

The Secretary of Homeland Security may designate a foreign country for TPS due to conditions in the country that temporarily prevent the country's nationals from returning safely, or in certain circumstances, where the country is unable to handle the return of its nationals adequately. Important announcement regarding Employment Authorizations for all TPS holders:

On July 21, 2026, a federal court stayed two USCIS policies that limit TPS-related employment authorization periods to one-year. The Court ordered that this stay remains in effect until furher orders and plans to issue another decision on or before August 5, 2026.

As a result of this order:
• Any 540-day automatic EAD extension issued to a TPS holder who filed an application between January 17, 2025 and March 18, 2025 to renew a TPS-related EAD with a March 9, 2025 or April 19, 2025 expiration date remains valid pending further order of the court. Automatic extensions do not expire on July 22, 2026.

• Any TPS-related EAD with an expiration date between July 22, 2026 and September 8, 2026 issued to a TPS holder from El Salvador who applied for a TPS EAD before July 4, 2025 remains valid pending further order of the court. As a reminder, TPS for El
Salvador is currently extended through September 9, 2026.

• Any TPS-related EAD with an expiration date between July 22, 2026 and October 18, 2026 issued to a TPS holder from Sudan or Ukraine who applied for a TPS EAD before July 4, 2025 remains valid pending further order of the court. As a reminder,
TPS for Ukraine and Sudan is currently extended through October 19, 2026.
