With the passage of Prop 207 last night people with possession of ma*****na and related convictions will be able to seek expungements of those convictions from their records beginning in July! If you have a previous conviction for ma*****na or any other offense it is always a good idea to clean your record as much as possible once you have served your sentence. We are always happy to help individuals seek set asides and expungements when they qualify!

Fellow Tucsonans, here is the emergency proclamation that the mayor just enacted. As a reminder, a Class One Misdemeanor may carry up to six months in jail, $2500 in base fines for individuals (surcharges can make this more expensive) or $20,000 in base fines for enterprises. What is better than Alex Trebek? What about Double Jeopardy? AZ Supreme Court upheld that future prosecutions are barred by double jeopardy when an accused is convicted of a lesser-included offense even when the jury does not agree as to guilt or innocence on the greater offense.

New Arizona Court of Appeals Opinion finding it unconstitutional for a judge and not a jury to determine the value of dangerous drugs for purposes of sentencing with fine enhancements. While not reversing the conviction, the court affirmed it is the jury’s responsibility to determine sentencing aggregators.
