Don’t freak out if you get a long RFE, most of it is copy paste just to get the case officer breathing room and does not mean you have a bad case. But it is a challenge to prove you deserve an approval when they don’t even read what you submit.

If your EB-1A or EB-2 NIW gets denied, you can appeal, refile, or give up. You’re not a quitter so let me explain why refiling is generally more likely to lead to an approval. While riskier, winning on appeal does have one major advantage. If you can, do both, but quality filings are more important than just throwing filing fees and poorly written arguments at USCIS.

Foreigners on E-3, H-1B, O-1, or L-1 status who have an approved I-140 in a backlogged category can apply for an EAD card to stay in the US if they get laid off or their status expires. They must demonstrate “compelling circumstances” for this special EAD category.

Another way someone could switch from a temporary E2 investor visa to permanend residence (green card) is by self-petitioning for an EB2 NIW. We just helped someone with an NIW who is currently in the US on an E2 visa. We filed their RFE response and USCIS approved their case today! Now they are on the waitlist and can soon apply for a green card without needing a sponsor.
