Under Georgia law, the judge in a child custody case has the final decision authority, not a jury and not even the parents. However, judges almost always accept a custody agreement the parents themselves propose. Therefore, it is best to try and reach that agreement with the other parent—this way you maintain control of the parenting rights to your children.

I've settled two cases recently where my clients were assaulted in some way by another person. Both of my clients did not have significant injuries in any way, but they were nonetheless violated or disrespected. In each case my clients agreed to take less money in settlement because the defendants agreed to write an apology letter to my clients. An honest apology goes a long way, and everyone can move on.
