BEFORE YOU MAKE YOUR NEXT SOCIAL MEDIA POST - READ THIS! FIGHT BACK WITH THE LAW IF YOU ARE THE VICTIM OF CYBER-HARASSMENT OR CYBER-STALKING!
We are being asked this question now almost everyday.
It is a crime in Tennessee for any person to harass another person by any form of communication, including email, text message, or with social networking posts (Facebook, Twitter, Instagram etc…)
As used in Tenn. Code Ann. 39-17-308:
(1) “Communicate” means contacting a person … on social networks, social media, or websites;
Tenn. Code Ann. 39-17-308. Harassment - A person commits an offense who intentionally: Communicates with another person without lawful purpose, anonymously or otherwise, with the intent that the frequency or means of the communication annoys, offends, alarms, or frightens the recipient and, by this action, annoys, offends, alarms, or frightens the recipient;
This is generally an A misdemeanor punishable by up to 11 month 29 days in jail and a $2,500 fine.
More importantly it should stop the cyber bullying as the Defendant would be prohibited from contacting the victim.
STALKING: By making repeated contact with another person without that person's consent, including contact through electronic communications, social media or via the internet, an individual in Tennessee may be engaging in criminal stalking. (Tenn. Code Ann. § 39-17-315). Repeated social networking posts (Facebook, Twitter, Instagram etc…) referencing the person can be stalking as unconsented” contact. “Unconsented contact” means any contact with another person that is initiated or continued without that person's consent, or in disregard of that person's expressed desire that the contact be avoided or discontinued. Unconsented contact includes, but is not limited to “Sending to that person mail or any electronic communications, including, but not limited to, electronic mail, text messages, or any other type of electronic message sent using the internet, websites, or a social media platform.”
Criminal stalking is generally an A misdemeanor punishable by up to 11 month 29 days in jail and a $2,500 fine. More importantly, it should stop the cyber bullying as the Defendant would be prohibited from contacting the victim.
If you are the Victim of Cyber-Bullying we suggest you collect every questionable post and report them as a whole to local law enforcement or your local District Attorney’s Office. Demand these laws be enforced.

David Montgomery Hardee
Jackson - David Montgomery Hardee was born on May 26, 1953, to the late Alta Ruth Montgomery and Robert Hardee. He died on March 17, 2021 after a courageous and faith-filled battle with COVID. David was born in Jackson and raised in Denmark, Tennessee. He graduated from North Side High School in 1971 and from UT Martin (where he was a proud ATO, cannons and all) in 1975. In 1978 he received his Juris Doctorate from Cumberland School of Law at Samford University. He began practicing law with the late Judge Whit LaFon and became a partner in 1982. Hardee, Martin & Owens, his present firm with Bradley Owens was formed by David and his longtime partner Patrick Martin in 1986.
David was a "lawyer's lawyer" who loved his legal work and woke up early every day to get to the office. He truly cared about each and every client he helped and took on their battles as his own. He was admitted to practice in all Tennessee courts and the U.S. District Court for the Western District of Tennessee. He was a member of the local, state, and American Bar Associations, the state and American Associations for Justice, and the Inns of Court (Master). David was passionate about politics and was President of the Tennessee Young Democrats in 1984, was the local chairperson for the presidential primary campaign of Gary Hart, and was a member of the original Gore Corps, riding a bus overnight to Iowa for the caucus in 1988. Most important to him was his faith in Jesus Christ. He served on the Faith Health Center Board and was an active member of Northside Church. David has said many times that if his life leads one person to know Jesus, it was a life well spent. His favorite verse, said and lived, was "I can do all things through Christ, who strengthens me." Philippians 4:13.
David is deeply loved by his wife of 25 years, Tammy Cox Hardee; his children Angela Snider (Karl), Danielle Hardee (Eric Rooks), Katherine Alexander (Callaway), Laura Beth Hardee, Brian Weir (Danielle), and Heather Williams; his grandchildren Kaylee and Cole Snider, David and Emmett Rooks, Callaway Alexander II, Paxton and Gage Weir, and Shelby and Aidan Robertson; his sisters Sylvia DiMarco (Joe) and Rayna Bomar; and nieces and nephews. He was predeceased by his parents, a brother-in-law Hugh Bomar, and a nephew Samuel David Bomar.
David was always ready to talk about his kids and grandkids, the UT Volunteers, the St. Louis Cardinals, his incredible garden which he readily shared, golf trips and shenanigans with his buddies, his love for good rock & roll (so take those old records off the shelf!), and his beloved Charlie the Bulldog.
A service will be held at Northside Church on Sunday, March 21st at 5:00 p.m. with visitation beginning at 2:00 p.m. Social distancing and face masks are required and will be enforced. The service will be livestreamed on Northside Church's page. A private burial will follow.

Few Law Changes in TN - These new laws are in effect as of January 1, 2021:
Anyone who purchases ci******es, v**e products, or other to***co items must be at least 21-years-old. The law previously allowed anyone who was 18 to buy to***co.
Changes to the AMBER Alert system take effect. The new system allows AMBER Alerts to be issued for individuals 21 and younger. The AMBER Alert system was previously used for people 18 and under only.
RIghts have been expanded for pregnant women in the workplace. The Pregnant Workers Fairness Act empowers women to request more accommodations at work.
New legislation takes effect that allows 911 operators across the state to provide CPR instructions to callers in an emergency. Before January 1, not all counties allowed 911 operators to give callers CPR instructions.

As a local business owner, I believe it is important to invest in your community and invest, most importantly, in the future of our community with educational opportunities. As the father of a 10-year-old avid reader, the library is a special place for children that needs to be preserved and improved.
🔹 What do you love about the Gibson County Library?
The awesome staff is always there to provide a helping hand in finding the right item for your particular mood/desire or to give suggestions for items you may not have known were available.
🔹 What do you love about the Gibson County community?
I made Gibson County my home almost 10 years ago and fell in love with it almost immediately. The people are genuine, it has just about all we would ever need within a short drive and the schools and facilities make GC a great place to raise a family.
🔹 List something that you think most people may not know about the Gibson County Library, but that they should know. Even though it is currently a relatively small facility, the Gibson Co. Library can still offer patrons access to thousands of books, movies, and audiobooks by borrowing them from other libraries with the InterLibrary Loan Service.
🔹 Anything else you feel is important to share?
I am saved by grace. I am a father to Meredith and Husband to Robin. I am a partner in the law firm of Hardee, Martin and Owens located on Court Square in Trenton.
