You have heard me discuss the issue of web3 platforms looking too much like web2 platforms across various issues. One of these issues is accountability. Below is a blog post (and notice of "intent to arbitrate" letter to OpenSea) that describes a scenario experienced by one of our clients whose wallet was hacked. OpenSea was unable to provide timely support. The support that was provided was inept. OpenSea essentially converted the user's to their own control, refusing to release those NFTs in contravention of its own policies. They made a bad situation worse, then sought to capitalize on the misfortune of its user (knowing that theft is rampant and that even the most sophisticated NFT enthusiast are getting hacked).

But when the rubber hits the road, many of these platforms (i.e. Airbnb)(you have seen my posts about the hundreds of arbitration we have filed against Airbnb) defrauded customers onto their platform with marketing BS that promised safety but fail to deliver. The marketing department says one thing. The lawyers for these platforms essentially argue that the Terms of Service say "we can do whatever we want, whenever we want, for whatever reason we want" ... and BTW you are not entitled to any damages even if we steal your money).

I am hopeful that will be different and that many of these centralized platforms in the space will devote the resources necessary to become accountable and transparent to the users who trust them.
