Important information as we head into October!

As children head back to school, important car seat and seatbelt laws are now in effect:

-Booster seat required when using a lap belt from age 5 up to 8 years or until 4'9" tall—whichever comes first.

-All children under 13 must ride in the rear seat, if one is available.

-Proper restraint—a car seat or booster seat—is mandatory until age 8 or 4'9", regardless of age or size milestones.

Staying safe is the first step to start a new school year.

We are presently investigating potential privacy violations by FLAGSTAR Bank regarding the breach of privacy information including sensitive information like name, social security number, and financial information.

This is the second recent breach of FLAGSTAR and has affected over one million customers.

With the explosion of development in Northern Michigan, we often find people wanting to challenge the zoning and planning decisions of nearby development. The Michigan Supreme Court just made it easier for concerned citizens to challenge decisions they disagree with by letting them appeal a decision as an "aggrieved party."

“First, the appellant must have participated in the challenged proceedings by taking a position of the contested proposal or decision. Second, the appellant must claim some protected interest or protected personal, pecuniary or property right that will be or is likely to be affected by the challenged decision. Third, the appellant must provide some evidence of special damages arising from the challenged decision in the form of an actual or likely injury to or burden on their asserted interest or right that is different in kind or more significant in degree than the effects on others in the local community.”

If you have a concern, it is important to participate at your local planning or zoning appeal board meeting. This decision will provide citizens with additional avenues to participate in the future of their neighborhoods.

To our clients and anyone else with matters pending before Michigan courts: The Michigan Supreme Court has issued an order to all local courts that will remain in effect until at least April 3, 2020. Under this order, court activity will be limited to "essential functions."

For civil cases, this means that nearly all cases will either be adjourned until after April 3, or conducted by remote conferencing.

For criminal cases, most matters other than pleas, sentencing, and arraignments will also be adjourned - including all criminal trials.

For probate cases, most non-emergency matters will either be adjourned or conducted by remote conference.

The 86th District Court - covering Grand Traverse, Leelanau, and Antrim Counties - has updated its policies and procedures in response to the ongoing Coronavirus situation. Until at least May 1, all civil cases are adjourned, along with all misdemeanor criminal matters, and various felony cases.

Only "parties essential to a case" will be allowed in the courthouse. Full details are set out in the attached notice.
