In the recent past I have worked on two estates where the individual had a trust; however, their real property was not properly conveyed or vested in the trust.

Of course, this defeats the very purpose of having a trust in the first place--to avoid probate.

Another matter I specialize in is driver’s license restoration. As some of you are probably aware if you have two alcohol-related driving offenses within five year’s time the Secretary of State (SOS) will automatically (after notice) revoke your driving privileges indefinitely.

At that point your only remedy is to petition the SOS by submitting a Request for an Administrative Review. It is a detailed process, which includes a number of prerequisites to submitting the petition. Ultimately, there will be an administrative hearing where the petitioner must demonstrate to an Administrative Law Judge by clear and convincing evidence that his (or her) alcohol abuse problems, if any, are under control or likely to remain under control, and that the risk of repeating their past abusive behavior is low or at a minimal risk.

It is not a simple process and there are a number of pitfalls, but given my 30 years of practice experience I can certainly increase your chances to restore your driving privileges. Call me today!

Eventually our State will welcome warmer temps, the snow will melt, and those who own motorcycles will happily hit the road. As always, be careful!

For all you riders a couple of points about operating your motorcycle in Michigan are important to note. The first is that is that you shouldn’t ride without a certificate of insurance on your bike. This is important because although motorcycles are not considered vehicles for the purpose of triggering the No-fault act, if another driver of an automobile actively contributes to your accident, the motorcyclist can recover from the driver’s insurance company only if he (or she) has a certificate of insurance on their bike. So get insurance!

Second, although actual physical contact is not required with an automobile to trigger coverage, it depends upon the circumstances of your situation and each accident is unique. Appellate case law more fully explains whether another vehicle might be actively as opposed to passively involved in the accident.

Within the last year I have probated a couple of estate's where the decedent passed intestate (or without a Will). In each case some of the heirs at law; that is, those who inherited by statute rather than direct devise had absolutely no relationship with the decedent. All the more reason to have a Will.
